The term "kitchen waste generating units" as mentioned in these Measures refers to the production and business operation units that provide food to consumers through instant processing, commercial sales and service labor, including restaurants, snack bars, fast food restaurants, canteens, shopping malls and supermarkets that provide food consumption.
The term "waste edible oil" as mentioned in these Measures refers to the oil in kitchen waste, oil-water mixture and the oil produced after separation by oil-water separator and grease trap.
The kitchen waste generated by residents' daily life should be treated separately from other domestic wastes and gradually incorporated into the centralized treatment scope of kitchen waste. Article 4 The municipal and district governments (including the management institutions of the new district, the same below) shall organize relevant departments to carry out publicity work on the management of kitchen waste, support the development of kitchen waste treatment technology and the construction of facilities, and promote the harmless treatment and resource utilization of kitchen waste.
Encourage kitchen waste generating units to install kitchen waste pretreatment facilities to pretreat kitchen waste. Article 5 The municipal urban management department (hereinafter referred to as the municipal competent department) is responsible for the management of the collection, transportation and treatment of kitchen waste in the whole city, and its main responsibilities are:
(a) to guide, coordinate, supervise and inspect the management of kitchen waste in various districts;
(two) according to the relevant provisions of the management of municipal solid waste, the issuance of kitchen waste collection, transportation and disposal license and kitchen waste transport vehicle navicert;
(three) to supervise the operation of kitchen waste treatment facilities;
(four) according to the prescribed procedures to develop technical specifications for the collection, transportation and treatment of kitchen waste and organize their implementation. Article 6 The district urban management department (hereinafter referred to as the district competent department) is responsible for the daily management of kitchen waste within its jurisdiction, and its main responsibilities are:
(a) to supervise and inspect the collection, transportation and treatment of kitchen waste, and to track and manage the whole process;
(two) responsible for checking the collection, transportation and treatment of kitchen waste;
(three) to investigate and deal with illegal discharge, collection, transportation and disposal of kitchen waste. Article 7 The market supervision and management department shall be responsible for the supervision and management of food production, processing and circulation, investigate and deal with illegal acts of producing and processing food with kitchen waste as raw materials, and investigate and deal with illegal acts of selling fake and shoddy edible oils and fats according to law.
The human settlement environment department is responsible for the supervision and management of pollution prevention measures of kitchen waste generating units and collection, transportation and treatment enterprises, and investigating and punishing illegal acts of environmental pollution in the process of kitchen waste collection, transportation and treatment according to law.
The water department is responsible for the management of rivers and drainage, and investigate and deal with illegal acts of discharging kitchen waste into rivers and public drainage facilities according to law.
The traffic police department of public security shall issue a license within three working days from the date of accepting the application that the kitchen waste transport vehicles filed with the competent department need to pass in the no-go area, so as to provide convenience for the kitchen waste transport vehicles to collect and transport kitchen waste.
The administrative departments of education, health, culture, sports and tourism shall assist the competent departments to carry out the management of kitchen waste, and urge the units in charge of their respective industries to perform their duties as prescribed in the present Measures. Article 8 The catering trade association shall play the role of industry self-discipline and standardize the collection, transportation and disposal of kitchen waste in this industry. Promote the reduction of kitchen waste, incorporate the management of kitchen waste into the scope of rating and integrity management of catering enterprises, and urge catering enterprises to do a good job in the harmless treatment of kitchen waste. Article 9 The collection, transportation and treatment of kitchen waste in this Municipality shall be subject to the franchise system.
The kitchen waste generating unit shall hand over the kitchen waste generated to the franchise enterprise for collection, transportation and treatment. Enterprises and individuals without franchise shall not collect, transport and treat kitchen waste. Article 10 An enterprise applying for a license for the collection, transportation and disposal of kitchen waste shall meet the following basic conditions:
(1) Having the qualification of an enterprise legal person;
(2) The technologies and processes adopted meet the requirements of relevant national standards and have passed professional evaluation;
(3) More than 65,438 fully enclosed kitchen waste removal vehicles with the functions of preventing odor diffusion, spillage and leachate dripping, and equipped with driving and loading and unloading recorders;
(four) the daily processing capacity of kitchen waste is not less than 200 tons;
(5) There shall be no less than 5 persons with professional technical titles such as environmental protection, chemical engineering, biology and machinery. Among them, there are no less than 1 person with professional and technical titles at deputy senior level or above, and the technical director has professional and technical titles at intermediate level or above and has more than 5 years of garbage disposal experience;
(six) the installation and use of online video monitoring equipment and networking with the competent authorities;
(seven) has a fixed office space, machinery and equipment and vehicle parking places. Article 11 The municipal government may, according to the actual management needs, divide the whole city into several areas and grant different kitchen waste collection, transportation and treatment enterprises to operate.
Authorized kitchen waste collection, transportation and treatment enterprises shall conduct unified collection, transportation and centralized fixed-point treatment of kitchen waste within the authorized area.
