Chapter I General Principles

Article 1 In order to strengthen the classified management of municipal solid waste, improve the level of reduction, recycling and harmlessness of municipal solid waste, and improve the living environment, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of Urban Appearance and Environmental Sanitation, and the Regulations on the Administration of Urban Appearance and Environmental Sanitation of Kunming. , combined with the actual situation of this city.

Article 2 These Measures shall apply to the classified delivery, classified collection, classified transportation, classified disposal and related activities of domestic garbage in the urban planning area of this Municipality and other areas designated by the municipal government for urbanization management.

Article 3 The classified management of municipal solid waste shall follow the principles of government promotion, participation of the whole people, source reduction and local conditions.

Article 4 Domestic garbage is divided into harmful waste, perishable garbage, recyclable garbage and other garbage, and the classification standards are as follows:

(1) Hazardous waste refers to discarded batteries (nickel-cadmium batteries, mercury oxide batteries, lead batteries, etc. ), fluorescent tubes (fluorescent tubes, energy-saving lamps, etc. ), sphygmomanometer, thermometer, medicine and its packaging, waste paint, solvent and its packaging, waste pesticide, disinfectant and its packaging, waste film, waste photographic paper, etc.

(2) Perishable garbage refers to the kitchen garbage produced by canteens, hotels and restaurants of relevant units and kitchen garbage produced by families, as well as vegetable and fruit garbage, carrion, broken bones, eggshells, internal organs of livestock and poultry products produced by farmers' markets and agricultural products wholesale markets;

(3) Recyclable materials mainly include waste paper, waste plastics, waste metals, waste packaging materials, waste textiles, waste electrical and electronic products, waste glass, waste paper aluminum-plastic composite packaging and other recyclable materials;

(4) Other garbage refers to municipal solid waste other than recyclables, perishable garbage and hazardous waste.

Article 5 The people's governments of cities and counties (cities, districts) and the administrative committees of development (holiday) parks shall strengthen their leadership over the classified management of municipal solid waste, formulate policies and measures for the classified management of municipal solid waste, establish a guarantee mechanism for the investment of institutions, personnel and funds, coordinate the handling of major problems in management, and realize the classified management objectives of municipal solid waste.

Sub-district offices shall, in accordance with the provisions of these measures, organize and implement the classification of urban domestic waste within the region.

Article 6 The municipal comprehensive administrative law enforcement department of urban management is the competent department of municipal solid waste classification, responsible for organizing the implementation of these measures, and guiding and supervising the classified management of municipal solid waste.

The comprehensive administrative law enforcement department of urban management of counties (cities, districts) and development (holiday) parks is responsible for the specific work of classified management of urban domestic waste within their respective jurisdictions.

Article 7 The competent commerce department is responsible for formulating and implementing industrial policies, standards and development plans for recycling renewable resources, and supervising and managing the recycling of recyclable materials.

The competent administrative department of environmental protection is responsible for the supervision and management of hazardous waste transportation and loading and unloading.

The construction administrative department is responsible for the supervision and management of the domestic waste classification of the property service enterprises.

The administrative department of education is responsible for incorporating the relevant knowledge of domestic waste classification into the environmental education content of schools in this Municipality, popularizing the knowledge of domestic waste classification and cultivating the habit of domestic waste classification.

The medical and health administrative department is responsible for guiding the classification of domestic waste in the medical and health system.

The administrative departments of transportation, tourism, press and publication, radio and television are responsible for urging relevant units to do a good job in the publicity and implementation of domestic waste classification within their service and management scope.

Other departments shall, in accordance with their respective responsibilities and the provisions of these measures, do a good job in the classified management of domestic waste.

Eighth residents' committees shall cooperate with the county (city, district) street offices and urban management comprehensive administrative law enforcement departments, and develop (holiday) parks to do a good job in the publicity and implementation of domestic waste classification.

The owners' committee and the realty service enterprise shall mobilize and urge the residents in residential areas to put domestic garbage in a classified way and do a good job in the classified collection of domestic garbage.

Article 9 Units and individuals shall put domestic garbage in different categories according to the regulations, and shall not abandon, dump or pile up domestic garbage at will.

Chapter II Establishment of Classification Facilities

Article 10 The municipal comprehensive administrative law enforcement department of urban management shall, jointly with the relevant municipal administrative departments, prepare the implementation plan and facilities specification for the classified management of urban domestic waste in this Municipality, and organize the implementation after the approval of the municipal government.

Article 11 County (city, district) people's governments, development (holiday) park management committees and subdistrict offices shall organize the construction, installation or renovation of garbage transfer stations, garbage houses, hazardous waste temporary storage points, garbage sorting centers, garbage collection containers and other places, facilities and equipment within their respective jurisdictions in accordance with the implementation plan and facilities setting specifications for urban domestic waste classification management.

Organs, organizations, schools, enterprises and institutions, airports, railway stations, passenger stations, bazaars, parks, residential quarters, etc. Facilities and equipment such as domestic waste sorting and collection containers shall be set up and managed in accordance with the provisions of these Measures.

Twelfth domestic waste sorting facilities and equipment should be regularly maintained and cleaned to keep their appearance and function intact, neatly placed, clean and sanitary, and there is no scattered garbage and sewage around.

Chapter III Classified Delivery

Thirteenth domestic garbage shall be classified in accordance with the following provisions:

(1) Putting hazardous wastes into hazardous waste collection containers or handing them over to qualified hazardous waste treatment enterprises for treatment;

(2) putting perishable garbage into a perishable garbage collection container;

(3) putting the recyclables into a recyclables collection container;

(4) Dumping other garbage into other garbage collection containers.

Article 14 This Municipality shall implement the system of responsible person for the management of classified delivery of domestic garbage.

In the area where property management is implemented, the property service enterprise is the person in charge of management. If there is an agreement on the responsibility of the person in charge of management in the property service contract, such agreement shall prevail.

If property management is not implemented, the person responsible for management shall be determined in accordance with the following provisions:

(a) the office or production and business premises managed by organs, organizations, schools, enterprises, institutions and other organizations, and this unit is the person in charge of management;

(two) the owner manages the residential area of the property by himself, and the owner or the owners' committee is the person responsible for the management;

(three) accommodation, entertainment, shopping malls, shops, bazaars, exhibitions and other places of business, business management units for the management responsibility;

(four) airports, railway stations, long-distance passenger stations, bus stations, subway stations, ports, cultural and sports venues, parks, tourist attractions (communities) and other public places, the management unit is the person in charge of management;

(5) The construction site shall be managed by the construction unit;

(6) Urban roads, expressways, footbridges, underground passages, etc. Cleaning and cleaning units are responsible for management.

In accordance with the provisions of the second and third paragraphs of this article, the person in charge of management cannot be determined, and the local sub-district office is responsible for determining the person in charge of management.

The owners, the owners' committee and the realty service enterprise shall, when signing the realty service contract, stipulate the requirements for the classified delivery of domestic garbage. The property management unit that implements the outsourcing of cleaning and cleaning shall incorporate the classification requirements of domestic garbage into the cleaning and cleaning service contract, and supervise the implementation.

Fifteenth management responsible person shall abide by the following provisions:

(1) Setting up and managing domestic garbage collection containers in accordance with relevant regulations;

(two) the establishment of daily management system of domestic waste classification, announced the time, place and way of different types of domestic waste;

(three) to publicize and guide the classified delivery of municipal solid waste, and to advise and stop the behavior that does not meet the requirements of classified delivery, classification or mixed classification of municipal solid waste;

(4) Classifying and collecting domestic garbage to garbage collection points or handing it over to qualified units for collection;

(five) to guide and urge the cleaning staff to classify according to the classification standard of domestic waste.

Sub-district offices can sign letters of responsibility with the management responsible person according to the needs.

Travel agencies that organize and receive tourists in this Municipality shall perform the duties in Item (3) of Paragraph 1 of this Article.

Article 16 State organs, institutions, mass organizations and state-owned enterprises shall strengthen their leadership over the classification of municipal solid waste, improve the classification system of municipal solid waste in their own units, clarify internal management posts and responsibilities, and establish a team of garbage classification supervisors and volunteers.

Chapter IV Classified Collection, Transportation and Disposal

Seventeenth municipal solid waste should be collected separately, and it is forbidden to collect municipal solid waste separately.

Collect recyclable materials and hazardous wastes regularly according to relevant regulations and requirements. Perishable garbage should be collected and transported in time after classified delivery, so as to achieve daily production and daily cleaning.

Eighteenth units engaged in the classified collection of municipal solid waste shall comply with the following provisions:

(a) according to the requirements of domestic waste collection, classification and operation time. , equipped with qualified acquisition equipment and personnel;

(two) regularly collect domestic garbage in designated places, and shall not be mixed, dumped, discarded, scattered or piled up at will;

(three) to clean up the job site in time and keep the domestic garbage collection facilities and the surrounding environment clean and tidy;

(four) establish a collection management ledger to record the source, type, quantity, destination and other information of domestic garbage;

(five) other provisions of the state, province and city on the classified collection of municipal solid waste.

Article 19 Domestic garbage collected by classification shall be transported by classification, and mixed transportation of domestic garbage collected by classification is prohibited.

Hazardous wastes shall be transported to the designated storage and treatment points in accordance with the provisions and requirements of relevant laws and regulations.

Perishable garbage shall be transported to the designated place according to the prescribed time, route and requirements.

Twentieth units engaged in classified transportation of municipal solid waste shall comply with the following provisions:

(a) transport vehicles must be sealed, and shall not be leaked or scattered;

(two) after the transfer station, it shall be sealed and stored for no more than 24 hours;

(three) the establishment of transportation management ledger, record the source, type, quantity, destination and other information of domestic waste transportation;

(four) to formulate emergency plans for vehicle emergency deployment, traffic accident handling, transportation route change and other emergencies;

(five) other provisions of the state, province and this Municipality on the classified transportation of municipal solid waste.

Twenty-first municipal solid waste shall be classified in accordance with the relevant provisions and technical standards.

Recyclable materials are recycled by renewable resource utilization units or enterprises, and the recycled products are promoted to directly enter the commodity circulation field.

Perishable garbage should be recycled or otherwise treated harmlessly through biological treatment and other technologies.

The disposal of hazardous wastes shall comply with the relevant provisions of the state, and relevant units shall take effective pollution prevention measures to prevent secondary pollution.

Other garbage should be treated harmlessly by incineration or sanitary landfill.

Twenty-second units engaged in the classified treatment of municipal solid waste shall comply with the following provisions:

(a) in accordance with the provisions of the allocation of treatment facilities and management personnel and operators;

(two) the establishment of processing ledger, recording the transportation unit, type, quantity and other information of domestic waste;

(three) in accordance with the provisions of sewage, waste gas, waste residue, dust and other pollutants produced in the process of domestic garbage treatment, the establishment of environmental impact monitoring system to prevent pollution to the surrounding environment;

(four) to formulate emergency plans to deal with emergencies such as facility failure and accident handling;

(five) other provisions of the state, province and this Municipality on the treatment of municipal solid waste.

Chapter V Promotion Measures

Twenty-third newspapers, radio, television, Internet and other media in this Municipality shall, in accordance with the relevant regulations and requirements, carry out publicity and popularize the knowledge of domestic waste classification.

Outdoor advertising publishers shall, in accordance with the provisions, incorporate the classified public service advertisements of domestic waste into outdoor advertising content.

Article 24 The people's governments of cities and counties (cities, districts) and the administrative committees of development (holiday) parks shall formulate measures to promote and encourage the classification of municipal solid waste, guide and encourage units and individuals to participate in the classification and reduction of municipal solid waste, and encourage social capital to participate in the construction and operation of facilities for the classification, delivery, collection, transportation and treatment of municipal solid waste.

This Municipality shall implement the point reward system for the classified exchange of municipal solid waste, and the specific implementation measures shall be formulated separately by the municipal comprehensive administrative law enforcement department of urban management.

Article 25 The municipal and county (city, district) people's governments and the relevant departments of the Development (Holiday) Park Administrative Committee shall implement measures such as listing clean vegetables and cleaning agricultural and sideline products into the city to encourage fruit and vegetable wholesale markets and bazaars to recycle peels, vegetables and leaves.

Twenty-sixth property and domestic service enterprises should incorporate the classification and reduction of municipal solid waste into the content of job training.

Twenty-seventh commodity producers and sellers should strictly implement the national, provincial and municipal standards and requirements to limit the excessive packaging of products, and reduce the excessive use of packaging materials and the generation of packaging waste.

Chapter VI Supervision and Administration

Twenty-eighth cities and counties (cities, districts) urban management comprehensive law enforcement departments should establish a supervision and management mechanism for the classification of urban domestic waste.

Twenty-ninth street offices may hire supervisors, volunteers or entrust community workers and property service personnel to undertake the following duties:

(1) Publicity and guidance on the classification of domestic waste;

(two) check the classification of domestic waste;

(three) to discourage the behavior of putting and collecting domestic garbage in violation of the classification.

Thirtieth units and individuals found in violation of the provisions of the municipal solid waste classification management behavior, you can complain to the city, county (city, district) urban management comprehensive law enforcement departments. City, county (city, district) urban management comprehensive law enforcement departments should unblock the channels of complaint reporting, announce the ways, handling procedures and time limits of complaint reporting to the public, and inform the complainant of the handling results in a timely manner.

Thirty-first city, county (city, district) urban management comprehensive law enforcement departments in conjunction with relevant departments regularly through newspapers, radio, television, the Internet and other media, in violation of the provisions of the management of urban domestic waste classification to be exposed.

Thirty-second city, county (city, district) people's government, development (holiday) park management committee shall establish and improve the assessment system of urban domestic waste classification management, and in accordance with the provisions of the assessment results into the government performance appraisal system.

When declaring the activities of creating spiritual civilization such as civilized units, civilized families and civilized campuses, the reporting unit shall incorporate the classified management and implementation of domestic waste into the declaration.

Chapter VII Legal Liability

Article 33 State organs and their staff who neglect their duties, abuse their powers or engage in malpractices for selfish ends in the classified management of municipal solid waste shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirty-fourth in violation of the provisions of the classification of municipal solid waste, the comprehensive administrative law enforcement department of urban management shall order it to make corrections within a time limit; If no correction is made within the time limit, the unit shall be fined 5000 yuan to 50 thousand yuan, and the individual shall be fined in 200 yuan.

Thirty-fifth management responsible person in violation of the provisions of the first paragraph of article fifteenth of these measures, the comprehensive administrative law enforcement department of urban management shall order it to make corrections within a time limit, and may impose a fine of more than 2000 yuan 10000 yuan.

Chapter VIII Supplementary Provisions

Thirty-sixth laws, regulations and rules on the management of general industrial solid waste, construction waste, municipal sludge, medical waste, hazardous waste and other wastes, from its provisions.

Food and beverage operators and unit canteens shall carry out classified management of kitchen waste and bulky waste in accordance with relevant regulations.

Article 37 The classified management of domestic waste in areas other than those specified in Article 2 of these Measures shall be implemented in accordance with the principle of gradual implementation and step-by-step promotion, with reference to these Measures.

Article 38 These Measures shall come into force on March 1 day, 2065.
