Definition and composition of minimum wage standard

According to Article 48 of the Labor Law of People's Republic of China (PRC), the state implements the minimum wage guarantee system. The specific standard of the minimum wage shall be formulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and reported to the State Council for the record.

The minimum wage standard refers to the minimum labor remuneration that the employer should pay according to law on the premise that the laborer provides normal labor within the statutory working hours or the working hours stipulated in the labor contract signed according to law. (The normal labor mentioned above refers to the labor that the laborer engages in according to the stipulations of the labor contract within the legal working hours or the working hours agreed in the labor contract. Workers are deemed to have provided normal labor when they enjoy paid annual leave, family leave, funeral leave, maternity leave, birth control surgery leave and other holidays stipulated by the state, and when they participate in social activities according to law within legal working hours. )

The minimum wage does not include wages for extended working hours, housing and food subsidies paid by the employer in cash, allowances under special working conditions such as middle shift, night shift, high temperature, low temperature, underground, toxic and harmful, and social insurance benefits stipulated by national laws, regulations and rules.

The minimum wage is not real wages, but wages payable, including social insurance and individual contributions to housing provident fund.
