Provisions of Shenyang Municipality on Safety Management of Highly Toxic Substances
Chapter I General Provisions Article 1 In order to strengthen the safety management of highly toxic substances, prevent poisoning accidents and criminals from using highly toxic substances to carry out sabotage activities, and ensure the safety of public property and people's lives and property, these Provisions are formulated in accordance with the Regulations on the Safety Management of Hazardous Chemicals issued by the State Council and in combination with the actual situation of our city. Article 2 The toxic substances mentioned in these Provisions refer to substances that can cause serious harm or death to human body as long as a small amount invades human body, including cyanide, arsenic compounds, mercury compounds, selenium compounds, thallium compounds, beryllium compounds and other toxic substances and gases stipulated by public security organs.

The names of toxic substances shall be determined and published by the Municipal Public Security Bureau. Article 3 All units or individuals that produce (or trial-produce), store, sell, purchase, transport, hold and use toxic substances in our city shall abide by these provisions.

The management of highly toxic substances used in medicine (excluding medical laboratory tests) and pesticides shall be implemented in accordance with the relevant laws and regulations of the state, province and city. Article 4 Enterprises producing and dealing in toxic substances and warehouses storing toxic substances must keep a safe distance from residential areas, water sources and food factories. Article 5 Personnel who produce, keep, use and escort highly toxic substances must be politically reliable, have a strong sense of responsibility and be familiar with the performance and safe operation procedures of highly toxic substances. Newly hired personnel shall not work at their posts without technical training and safety education. Article 6 Units that produce, store, sell, transport and use toxic substances must establish and improve various safety management systems and operating rules, establish a responsibility system for safety posts, and set up safety management departments or safety supervisors as needed. Article 7 It is forbidden for any unit or individual to take, use, keep, give, transfer, resell or lend toxic substances, and it is forbidden to use toxic substances to poison fish, livestock and poultry. Article 8 Containers for the production, storage and transportation of highly toxic substances must be configured in accordance with the standards prescribed by the state and properly kept. If it is no longer used, it shall be approved by the public security, environmental protection and health departments, and safety measures shall be taken to ensure that it will not be destroyed after secondary poisoning, and it shall not be sold or used for other purposes. Ninth in the production, storage, transportation, sale and use of toxic substances in the process of major poisoning, leakage accidents or loss, theft and other cases, it should be promptly reported to the competent authorities and county, district public security organs. Tenth public security organs are responsible for the supervision and inspection of the safety management of highly toxic substances. The competent departments in charge of the production and operation of highly toxic substances, as well as the labor, health, environmental protection and industrial and commercial administrative departments, should cooperate with each other within the scope of their duties to do a good job in the safety management of highly toxic substances. Chapter II Production of Highly Toxic Substances Article 11 The construction, expansion and reconstruction of highly toxic substances production plants in our city must be approved by the Municipal People's Government and filed with the competent state department.

Township, town and street enterprises are prohibited from producing highly toxic substances. Article 12 Factories producing highly toxic substances shall set up corresponding safety facilities such as ventilation, fire prevention, explosion prevention, anti-virus, neutralization, pressure relief, monitoring, alarm, cooling, moisture prevention, lightning protection, anti-static and isolation operation according to the types and properties of highly toxic substances. Article 13 The product quality and packaging of highly toxic substances must meet the national standards. Toxic substances must be clearly marked before leaving the factory, and the product performance, use and safety precautions should be marked. If the product quality is unqualified or the packaging does not meet the requirements, it is not allowed to leave the factory. Fourteenth production of toxic substances, must have safety protection measures and appliances, the establishment of necessary fire and first aid organizations. Article 15 Pollutants such as waste water, waste gas and waste residue discharged from the production of highly toxic substances shall not exceed the standards set by the environmental protection department. Chapter III Operation of Highly Toxic Substances Article 16 To start an enterprise engaged in the operation of highly toxic substances, an application must be submitted to the municipal competent department, which, in conjunction with the public security and other relevant departments, will examine and approve it before it can operate. Seventeenth enterprises dealing in toxic substances must have operating facilities that meet the safety requirements, familiar professional and technical personnel and a sound management system. Article 18 When selling highly toxic substances, it is necessary to check the Purchase Certificate of Highly Toxic Substances (or the Purchase Registration Certificate of Highly Toxic Substances) issued by the public security organ and the letter of introduction from the purchaser, and register the varieties and quantities sold in detail. Article 19. Units that regularly purchase highly toxic substances can directly purchase highly toxic substances at designated stores with the registration certificate of highly toxic substances purchase and the letter of introduction of the unit, and temporarily purchase highly toxic substances. With the application form and the letter of introduction from the unit, you can apply to the local county and district public security organs for the purchase certificate of highly toxic substances and purchase them at designated stores. Twentieth foreign units to buy toxic substances in our city, with the purchase certificate issued by the county and district public security organs, directly to the designated store to buy.

Units in our city to buy toxic substances in other places must be approved by the county and district public security organs where the units are located. Twenty-second units that receive highly toxic substances allocated by the state may be exempted from purchasing procedures, but they must register with the local county and district public security organs for the record. Chapter IV Transport of Highly Toxic Substances Article 23 Transport of highly toxic substances must be accompanied by a transport certificate of highly toxic substances issued by the county or district public security organ at the place of arrival. With the "registration certificate for the purchase of highly toxic substances", those who buy highly toxic substances for transportation in urban areas are exempted from the "transport certificate for highly toxic substances".
