Chapter 1: General Provisions

Article 1 In order to standardize the city's green building evaluation and labeling management efforts, and to promote the high-quality development of green buildings. According to the Ministry of Housing and Urban-Rural Development "Green Building Labeling Management Measures" (Construction Standard Regulation 〔2021〕 No. 1) (hereinafter referred to as the "Measures"), "Shanxi Provincial Housing and Urban-Rural Development Department on the Green Building Labeling Management Notice" (Jinjian Ke Zi 〔2021〕 No. 146) (hereinafter referred to as the "Notice"), combined with the actuality of the city, to formulate the relevant provisions of the Measures.

Article 2 The green building labeling referred to in these measures refers to the green building star rating and contains performance indicators of information signs, including signs and certificates. Article 3 The scope of the green building labeling is awarded to civil buildings that meet the green building star rating standards.

Article 5 Taiyuan Municipal Bureau of Housing and Urban-Rural Development is responsible for green building labeling in the administrative area of the city. It has set up the Green Building Labeling Management Office, which is located in the Science and Technology and Energy Conservation Section of the Bureau, and is responsible for identifying one-star green buildings in the city, awarding labels and summarizing and reporting the identification information; it is also responsible for fostering the cultivation of star-grade green buildings in the city as well as the preliminary examination and recommendation of two-star and three-star green building labels.

Article 6 The following standards shall be adopted for determining the star-level green building labeling:

(1) The Green Building Evaluation Standards (GB/T50378-2019) shall be adopted for new civil buildings.

(ii) Existing building renovation adopts the Evaluation Standard for Green Renovation of Existing Buildings (GB/T51141-2015).

Article 7 The Municipal Housing and Urban-Rural Development Bureau establishes a green building expert pool at this level according to the work needs.

The experts shall be familiar with the national green building standards and relevant local regulations, understand and master the engineering planning, design, construction and other related technical requirements, have good professional ethics, have an associate senior or above technical title or obtain the relevant professional qualifications.

Experts involved in the identification of green building labeling should adhere to fairness, openness and impartiality, and avoid declaring projects with which they have a collateral relationship. Violation of the review provisions and review standards, depending on the circumstances, counted in the personal credit record, and removed from the expert database.

Article 8 One-star green building labeling review experts shall be composed of 7-9 lists.

Chapter II Declaration Conditions and Declaration Materials

Article 9 The declaration of green building labeling follows the principle of voluntariness, and is applied by the project construction unit, operation unit, or the owner unit, and the relevant units such as design, construction and consulting may **** participate in the declaration.

Article 10 Declaring green building labeling and projects should have the following conditions:

(1) Design, construction, operation and renovation in accordance with national standards such as Green Building Evaluation Standards (GB/T50378-2019) or relevant local regulations.

(ii) It has passed the acceptance of construction project completion and completed the record.

Article 11 For projects applying for green building labeling, the declaring unit shall provide the materials stipulated in Article 12 of the Measures and shall be responsible for the authenticity, accuracy and completeness of the materials.

Chapter III Declaration and Review

Article 12 Green Building Labeling needs to be declared, recommended, reviewed, publicized, published and so on, and the review includes formal review and expert review.

Article 13 The green building projects in line with the requirements of the Measures, the reporting unit by registering to log in the green building labeling management information system () to declare, submit the required declaration materials, and report to the project location of the housing and urban-rural construction management department.

Article 14 The Green Building Labeling Management Office will conduct the preliminary examination of projects declaring two-star and three-star green building labels within seven working days, and the content of the preliminary examination will be conducted in accordance with the content of the Notice.

Article 15 After the preliminary examination, the Municipal Green Building Labeling Management Office fills in the preliminary examination opinions in the Green Building Labeling Management Information System, recommends the two-star and three-star green building projects qualified in the preliminary examination to the Provincial Department of Housing and Urban-Rural Development, and uploads the recommendation letter.

Article 16 For the declaration of one-star green building labeling projects, the housing and urban-rural construction management department where the project is located logs into the green building labeling management information system, conducts the preliminary examination in accordance with the contents of the Notice, fills in the preliminary examination opinions, and submits the qualified projects to the municipal green building labeling management office.

Article 17 For one-star green building labeling projects that have passed the preliminary examination, the Green Building Labeling Management Office will organize expert examination within 15 working days to determine the examination opinions.

Article 18 Upon completion of the expert review, the Municipal Housing and Urban-Rural Development Bureau will make a public announcement on the portal. The content of the public notice includes the project location, type, name, reporting unit, green building star rating and key technical indicators, etc., the public notice period of not less than 7 working days. Signed written comments on the publicity project must verify the situation and deal with objections.

Article 19 For one-star projects without objections to the public notice, the Municipal Housing and Urban-Rural Development Bureau for approval and determination, the announcement of the determination of the one-star green building projects, and awarded the Ministry of Housing and Urban-Rural Development unified style certificate, the project unit in accordance with the green building labeling guidelines for the production of their own signage.

Chapter IV Supervision and Management

Article 20 The Municipal Housing and Urban-Rural Development Bureau shall strengthen the green building labeling work of power constraints on the operation of the construction of the monitoring mechanism, the scientific design of the workflow and supervision, clear management responsibilities and supervision measures, and effective prevention and control of integrity risks.

Article 21 All new buildings in our city should be designed in accordance with the "Green Building Design Standards" (DBJ04-415-2021). Chapter V Marking Management

Article 22 Encourage project units to declare green building marking, and give priority to all parties of the green building project who have obtained the marking in the evaluation of merits and priorities.

Article 23 The operating unit or owner of the project that has obtained the green building label should strengthen the operation and management of the green building, strengthen the operation indexes and the declaration of the green building star indexes, and annually report the main indexes of the annual operation to the green building label management information system.

Article 24 If a one-star green building labeling project has one of the behaviors stipulated in Article 22 of the Measures, the Green Building Labeling Management Office shall require the project unit to carry out rectification, and the rectification period shall be two years.

Article 25 If a one-star green building labeling project has one of the behaviors stipulated in Article 23 of the Measures, the Green Building Labeling Management Office will verify the project, put forward a written opinion, and the approval unit will approve the revocation of the green building labeling, and recover the label and certificate. The revoked green building labeling project shall not be allowed to participate in the evaluation of priorities and merits, and shall not enjoy the green building policy concessions given by the government.

Article 26 If the project construction unit or user disagrees with the result of the determination, it may apply for administrative reconsideration or file an administrative lawsuit according to law.

The approving unit shall inform the declaring unit in advance of the right of statement and defense before making the decision to revoke the one-star green building labeling. The facts and evidence submitted by the reporting unit should be reviewed, the facts and evidence should be adopted. Reasons shall be given for not adopting. Revocation of the decision should be sent to the reporting unit in a timely manner and to the public.

Chapter VI Supplementary Provisions

Article 27 Pre-evaluation of engineering projects can be referred to this approach in the project after the completion of the construction drawings and design of the pre-evaluation of green buildings, but does not grant the label.

Article 28 These Measures shall be interpreted by the Bureau of Housing and Urban-Rural Development of Taiyuan City.

Article 29 These Measures shall come into force from December 1, 2021 onwards.
