Legal analysis: kitchen waste refers to the food residue and waste edible oil produced by units engaged in catering services, collective feeding and other activities (including individual industrial and commercial households, hereinafter referred to as kitchen waste generating units) in the process of production and operation; Waste edible oils and fats refer to inedible animal and vegetable oils and various oil-water mixtures. The kitchen waste shall be treated separately, collected, transported and disposed centrally. Among them, the municipal and county (city, district) people's governments can determine the management requirements, methods and measures according to the local actual conditions for the kitchen waste generated by small restaurants, grocery stores and food vendors. Encourage the kitchen waste generated by residents' daily life to be put separately from other domestic wastes. Conditional areas will be gradually incorporated into unified collection, transportation and centralized disposal, and conditional communities can carry out on-site collection and disposal. City, county (city, district) people's government can take the form of government purchasing services, and social forces such as relevant social welfare organizations and environmental sanitation enterprises can carry out publicity, guidance and service activities on the delivery, collection and disposal of kitchen waste generated by residents' daily life.

legal basis: article 43 of the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste. local people's governments at or above the county level should speed up the establishment of a domestic waste management system for classified delivery, classified collection, classified transportation and classified treatment, so as to achieve effective coverage of the domestic waste classification system. Local people's governments at or above the county level shall establish a coordination mechanism for domestic waste classification, and strengthen and co-ordinate the capacity building of domestic waste classification management. People's governments at all levels and their relevant departments shall organize and carry out publicity on the classification of domestic waste, educate and guide the public to develop the habit of domestic waste classification, and urge and guide the classification of domestic waste.
