Regulations on Smoking Control in Public *** Places in Shanghai
Article 1 In order to eliminate and reduce the hazards of tobacco smoke, protect public health, create a good health environment in public **** places, and improve the level of civilization in the city, according to the relevant laws and administrative regulations, combined with the actual situation in the city, the formulation of these regulations. Article 2 The city's public **** place of smoking control work (hereinafter referred to as tobacco control work) applies to this Ordinance.

The tobacco control work referred to in the preceding paragraph refers to the adoption of effective measures to prohibit smoking in places where smoking is prohibited as stipulated in these regulations. Article 3 The city's tobacco control work to implement the "limited places, categorized management, unit responsibility, public participation" principle. Article 4 The municipal and district and county health promotion committees, under the leadership of the people's government at this level, are responsible for the organization and coordination of tobacco control work in the administrative area, guiding and supervising the tobacco control work of various departments and industries, and organizing and carrying out publicity and education activities for tobacco control work. The daily office of the Health Promotion Committee is located in the health administrative department at the same level.

Health, education, culture, radio, film and television, sports, tourism, food and drug supervision, transportation and ports, commerce, public security and other administrative departments in accordance with these regulations and other relevant provisions, to do a good job of tobacco control supervision and management work in public **** places. Article 5 The Municipal Health Promotion Committee shall organize and carry out various forms of tobacco control publicity and education work to enable the public to understand the hazards of tobacco smoke, and enhance the awareness of the whole society to create a smoke-free environment.

Related administrative departments, people's organizations and schools, hospitals and other units shall regularly carry out publicity and education activities on the hazards of tobacco smoke and tobacco control.

Radio, television, newspapers, magazines, websites and other mass media shall carry out smoking and passive smoking is harmful to the public health campaign. Article VI of the following public **** places where smoking is prohibited:

(a) child care centers, kindergartens, primary and secondary schools and juvenile palaces, youth activity centers, indoor and outdoor areas;

(b) In addition to the previous item of the various levels and types of schools, student dormitories, cafeterias and other indoor areas;

(c) Maternal and child health care hospitals (institutes), children's hospitals, children's welfare institutions, indoor and outdoor areas;

(c) Maternal and child health care institutions (institutes), children's hospitals, children's welfare homes areas;

(4) the indoor areas of various types of medical and health institutions at all levels other than the previous item;

(5) the indoor areas of stadiums and outdoor seating for spectators and competition venues;

(6) the indoor areas of various types of public ****cultural venues, such as libraries, theaters, concert halls, exhibition halls, museums, art galleries, museums, museums of science and technology, archives and other areas;

(vii) offices of state organs providing public **** services;

(viii) places of business of public utilities and financial institutions;

(ix) commercial places of business such as shopping malls, supermarkets, etc.

(x) elevators and their waiting areas;

(xi) buses and trolleys of public ****, taxis, railroad vehicles Public **** vehicles, passenger ferries and other public **** transportation and its ticket office, waiting room and set up in the indoor platform;

(xiii) other places provided for by laws and regulations. Article 7 The indoor areas of the following public **** places can be designated as smoking areas or set up smoking rooms, and smoking is prohibited outside the smoking areas and smoking rooms:

(1) entertainment venues such as cabarets, amusement halls and other entertainment venues;

(2) food and beverage establishments where the area used for the operation of the premises is more than 150 square meters or where the dining seats are more than 75 seats;

(3) star-rated hotels in the indoor public * **Activity area.

Hotels shall set up special non-smoking accommodation floors or rooms.

Airports, railroad passenger terminals, port passenger terminals, in addition to specially set up smoking rooms, smoking is prohibited in indoor areas. Article VIII of the public **** places designated smoking areas or set up smoking rooms, should have good exhaust conditions, and set up obvious signs and smoking is harmful to health and other tobacco control publicity signs. Article 9 Smoking is prohibited in indoor public **** activity areas such as meeting rooms, restaurants and **** workplaces of state organs. Article 10 Public ****places and workplaces other than those provided for in Articles 6 and 7 of these Regulations may, in accordance with the actual situation, set up no-smoking areas with reference to the provisions of these Regulations and do a good job of related management. Article 11 The Municipal People's Government may, in accordance with the provisions of these Regulations, temporarily set up the scope of no-smoking places according to the needs of organizing large-scale activities and the like. Article 12 The unit in which the no-smoking place is located shall perform the following duties:

(1) establish a no-smoking management system, and do a good job of no-smoking publicity and education;

(2) set up uniform no-smoking signs and telephone numbers of the supervisory departments in conspicuous places of the no-smoking area;

(3) do not set up any smoking-related appliances in the no-smoking area;

(4) set up a unified no-smoking sign and supervision department telephone number for those who smoke in the no-smoking area; and >(d) for smokers in the no-smoking area, take effective measures to prevent them from smoking or advise them to leave the premises. Article 13 Any individual may request smokers to stop smoking in no-smoking places; request the unit in which the no-smoking place is located to fulfill the duty of prohibiting smoking, and may report to the supervisory department for failure to fulfill the duty of prohibiting smoking. Article 14 The municipal and district and county health promotion committees shall organize relevant departments to strengthen the monitoring and evaluation of tobacco control work.

The Municipal Health Promotion Committee shall annually publicize the tobacco control work in the city. Article 15 The administrative department of health shall organize and carry out intervention work on smoking behavior, set up a hotline to carry out tobacco control consulting services.

Medical institutions shall provide guidance and assistance to smokers to quit.
