Article 1 In order to ensure the basic livelihood of urban residents and standardize the minimum living guarantee for urban residents, these Measures are formulated in accordance with the Regulations of the State Council on the Minimum Living Guarantee for Urban Residents and the relevant provisions of the province, combined with the situation of this Municipality.

Article 2 These Measures shall apply to the minimum living guarantee for non-agricultural registered permanent residence urban residents in this Municipality.

Article 3 The minimum living security system for urban residents (hereinafter referred to as urban minimum living security) adheres to the principle of combining government security with social assistance, encouraging self-help by labor, territorial management, socialized distribution and accepting social supervision.

Article 4 These Measures shall be organized and implemented by the municipal civil affairs department.

The district civil affairs department is responsible for the management and approval of urban subsistence allowances within its jurisdiction.

The sub-district offices and the Town People's Government under the District People's Government shall be responsible for the management and audit of urban subsistence allowances within their respective jurisdictions.

Community residents' committees and labor security workstations (hereinafter referred to as neighborhood committees) are entrusted by the civil affairs departments to be responsible for the daily management and services of urban subsistence allowances.

Finance, labor and social security, statistics, prices, auditing, health, education, industrial economy and other departments shall, in accordance with their respective functions and powers, do a good job in the relevant work of urban subsistence allowances.

Article 5 The municipal civil affairs department shall, jointly with the departments of finance, statistics and price, regularly put forward opinions on the standard of urban minimum living standard according to factors such as the expenses for basic living of urban residents, water, electricity, gas, coal (gas), compulsory education expenses for minors, price index changes, etc., and report them to the Municipal People's Government for approval before promulgation and implementation.

Article 6 Urban subsistence allowances shall be borne by the municipal and district finance in proportion, and shall be included in the fiscal budget at the same level respectively, and shall be included in the special account of financial and social security subsidy funds, which shall be used for special purposes, and no unit or individual may intercept or misappropriate them. The balance of urban subsistence allowances in the current year is carried forward to the next year to continue to be used.

Encourage social organizations and individuals to provide donations and subsidies for urban subsistence allowances, and all the donations and subsidies provided will be included in the scope of urban subsistence allowances.

Seventh non agricultural registered permanent residence city residents, where the average monthly income of family members living together is lower than the urban minimum living standard, can apply for urban minimum living allowance.

Family members mentioned in the preceding paragraph refer to persons who have the same household registration and have formed a relationship of support, upbringing or maintenance according to law.

Minors and adults who can't live independently are deemed to live together if they don't live together with their dependents or obligors.

College students (except graduate students and international students) and prisoners outside prison among family members are included in the family population.

Missing, absconding and serving prisoners are not included in the family population.

Article 8 The following monetary income and income in kind of family members living together are included in family income:

(a) fixed or temporary wages paid by the work unit and various bonuses, subsidies and other income;

(2) Income from renting or selling family property, various savings deposits, bonds or other securities, and other incidental income;

(3) legal expenses for maintenance, support or maintenance that should be paid by the supporter;

(four) inheritance, gift, survivors' allowance, social relief fund, basic pension, unemployment insurance, bankruptcy and other enterprise compensation income;

(five) income from planting, breeding, processing, commerce, setting up factories, etc. After deducting the necessary expenses;

(nine) other items that should not be included in the provisions of laws, regulations and rules.

Article 10 The non-agricultural registered permanent residence personnel in the urban area of this Municipality and the non-agricultural registered permanent residence personnel in the urban area of this Municipality form a family, and their remaining monthly income after retaining the standard amount of urban minimum living allowance is included in the monthly income of other family members.

Eleventh to apply for urban subsistence allowances, the monthly income of the family is calculated according to the average monthly income of the 6 months before the application (including the month of application); For families who can't calculate their income on a monthly basis, the monthly income is calculated according to the monthly average of their total income for the whole year.

Twelfth families whose per capita monthly income is lower than the urban minimum living standard shall not enjoy the urban minimum living allowance under any of the following circumstances:

(1) Laid-off and unemployed workers who have the ability to work within the age of employment refuse to accept employment introduction from employment agencies or neighborhood offices, town people's governments, community labor and social security institutions and other units twice without justifiable reasons;

(two) due to violation of family planning laws and regulations, the birth of children did not pay social support fees according to law;

(3) Family members do not repent of taking drugs, gambling and drinking;

(four) family members in primary and secondary schools at their own expense to choose schools or set up high-fee kindergartens;

(five) family members in institutions of higher learning or higher fees of departments or majors;

(6) The per capita housing area is 1 times higher than the urban per capita housing area standard in the previous year of this Municipality (if the family population is less than 3, it shall be counted as 3);

(seven) the purchase or high-grade decoration of housing within 2 years (except for the purchase of affordable housing due to demolition);

(eight) have cars, motorcycles, air conditioners, high-end pets and other non-essential consumer goods;

(9) Household appliances and high-grade furniture such as color TV sets, refrigerators and stereos newly purchased within 1 year with a single unit value exceeding 1000 yuan;

(ten) the daily consumption level of the family is significantly higher than the minimum living standard of this Municipality;

(eleven) there are acts such as investing in stocks.

Thirteenth residents to apply for urban minimum living allowance, should take the family as a unit, submit a written application to the neighborhood committee where the household registration is located, fill in the Application Form for Minimum Living Guarantee for Urban Residents in Harbin, and provide relevant supporting materials.

If the applicant provides false certification materials, his application will not be accepted within 1 year.

Fourteenth neighborhood committees shall register the application for urban subsistence allowances, and conduct investigation and preliminary examination in accordance with the following provisions within 12 days from the date of receiving the application and relevant certification materials:

(1) Organizing household surveys of three or more urban residents;

(two) the residents' committee organized the city residents' evaluation team to collectively evaluate whether the applicant meets the conditions for enjoying the city residents' treatment;

If the applicant's residence is inconsistent with the household registration, the neighborhood committee may appropriately extend the time limit for preliminary examination, but the longest time shall not exceed 10 day. The neighborhood committee of the applicant's place of residence has the obligation to cooperate with the neighborhood committee of the place where the household registration is located to investigate and understand the situation, and issue proof materials.

Fifteenth neighborhood committees should establish a mass supervision organization composed of representatives of the masses, improve the supervision mechanism of urban subsistence allowances, regularly disclose the list of urban subsistence allowances and the amount of urban subsistence allowances received, and accept the supervision of the masses.

Sixteenth street offices or town people's governments shall, within 10 days from the date of receiving the written application, relevant investigation materials, evaluation results and publicity reported by the neighborhood committees, conduct verification and evaluation in accordance with the following provisions:

(a) street offices or town people's government urban minimum living security assessment team organized more than 2 (including 2) staff to conduct household verification;

(two) street offices or town people's government urban minimum living allowance review team according to the verification of collective review;

(three) after examination, it is considered that it meets the conditions of enjoying urban subsistence allowances, and the results of the examination will be publicized in a conspicuous position convenient for mass supervision for 5 days; That does not meet the conditions to enjoy the urban minimum living allowance, the relevant verification materials and evaluation results will be reported to the district civil affairs department;

(four) after publicity, the relevant verification materials, evaluation results and publicity report to the district civil affairs department.

Sub-district offices or town people's governments can directly accept applications for urban subsistence allowances made by residents of newly-built residential areas who have not yet established neighborhood committees.

Seventeenth district civil affairs departments shall, within 8 days from the date of receiving the written application, relevant verification materials, evaluation results and publicity of the urban minimum living allowance reported by the subdistrict office or the town people's government, conduct examination and approval in accordance with the following provisions:

(1) Organizing personnel to conduct audits and spot checks;

(two) to meet the conditions of enjoying the urban minimum living allowance for families, the issuance of the "minimum living guarantee certificate for urban residents" (hereinafter referred to as the "minimum living allowance") and the passbook for receiving the urban minimum living allowance;

(three) for families who do not meet the conditions of enjoying urban subsistence allowances, the "Notice of No Protection" shall be entrusted to the neighborhood Committee to serve on the applicant, and the reasons shall be explained.

Eighteenth people who enjoy the treatment of urban subsistence allowances shall, within 30 days from the date of completing the household registration, go through the formalities for the change of "subsistence allowances" in accordance with the following provisions:

(a) I (or his family members, the same below) will return the "Low Guarantee" to the civil affairs department of the place where the household registration moves out, and the civil affairs department of the place where the household registration moves out will give him a copy of the urban minimum living security file and issue a certificate;

(3) The neighborhood committee of the place where the household registration is moved shall conduct investigation and verification within 3 days. Those who enjoy the treatment of urban residents who move out of the city's household registration shall promptly return the "low guarantee" to the district civil affairs department, which shall handle the cancellation procedures for enjoying the treatment of urban residents.

Nineteenth families who enjoy urban subsistence allowances are classified and managed in accordance with the following provisions, and they are approved to enjoy the corresponding urban subsistence allowances:

(a) Class A families refer to families whose family members have no source of income, no ability to work and no dependents, and enjoy them in full according to the urban minimum living standard;

(2) Class B families are non-labor families (those who have been able to work for a long time because of bedridden patients in nursing families are regarded as non-labor families, the same below) and have no income, and enjoy them in full according to the urban minimum living standard;

(three) C family without labor, income only survivors' allowance, alimony, alimony or alimony, enjoy the difference according to the urban minimum living standard;

(4) If a family of Class D has no labor force and has income other than survivor's allowance, alimony, maintenance fee and maintenance fee, it shall enjoy the difference according to the urban minimum living standard;

Twentieth to enjoy the special group of urban subsistence allowances, increase a certain amount of urban subsistence allowances. The specific amount shall be calculated regularly by the municipal civil affairs department in conjunction with the municipal finance department, and shall be promulgated and implemented after being approved by the Municipal People's Government.

Twenty-first people who enjoy the treatment of urban subsistence allowances shall enjoy the following social assistance in accordance with the relevant provisions:

(a) public schools in the compulsory education stage can reduce or exempt miscellaneous fees.

(two) in the designated hospitals for medical assistance for urban residents, enjoy basic medical assistance or medical assistance for serious illness.

(three) in line with the relevant provisions of the conditions, you can apply for low-cost housing.

(four) when the legitimate rights and interests are infringed, the relevant institutions shall provide legal aid.

The relevant municipal units shall, in accordance with the relevant provisions, give support and care to those who enjoy the treatment of urban subsistence allowances in employment, self-employment, heating, water supply, power supply, gas supply and demolition.

Twenty-second city residents to implement social distribution, enjoy the treatment of city residents to the designated bank passbook to receive the treatment of city residents.

Twenty-third neighborhood committees, neighborhood offices or town people's governments shall conduct quarterly audits and spot checks on families enjoying urban subsistence allowances, and the district civil affairs departments shall conduct spot checks every quarter. For families whose income changes, they should go through the formalities of increasing, decreasing or terminating the enjoyment of urban subsistence allowances in a timely manner in accordance with the prescribed procedures, and post them.

Twenty-fourth labor and social security, civil affairs and other departments should communicate with each other in a timely manner on the employment placement of people who enjoy the treatment of urban subsistence allowances and the situation of relevant personnel enjoying urban subsistence allowances.

The comprehensive management department of industrial economy should provide the civil affairs department at the same level with a list of enterprises that have not received wages or basic living expenses for more than 6 months, stopped production or business, and suffered long-term losses in a timely manner, and do a good job in information sharing involving urban subsistence allowances.

Article 25 The relevant units or individuals shall cooperate with the civil affairs departments, sub-district offices or town people's governments and neighborhood committees to investigate those who enjoy or apply for urban subsistence allowances, and truthfully provide relevant information, and shall not make false reports, conceal them or issue false certificates.

Twenty-sixth people who enjoy the treatment of urban subsistence allowances shall perform the following obligations:

(a) take the initiative to report the changes in family income to the neighborhood Committee where the household registration is located, and accept the audit and spot check. If the place of residence is inconsistent with the place of household registration, the household income shall be declared every month 1 time.

(II) Those who have the ability to work within the age of employment, take the initiative to find employment or accept the introduction of work by labor and social security agencies, and provide the neighborhood offices or town people's governments with employment status certificates issued by relevant units every three months, and report the employment situation.

(3) Those who have the ability to work within the age of employment but have not yet been employed shall participate in 8- 12 hours of public welfare labor organized by the neighborhood committees, neighborhood offices or town people's governments where their household registration is located every month, and shall not be replaced by other personnel.

Twenty-seventh personnel engaged in the management of urban subsistence allowances have one of the following acts, and they shall be criticized and educated or given administrative sanctions by their units or higher authorities; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(1) refusing to sign opinions on enjoying urban subsistence allowances for families who meet the conditions of enjoying urban subsistence allowances, or deliberately signing opinions on enjoying urban subsistence allowances for families who do not meet the conditions of enjoying urban subsistence allowances;

(two) corruption, misappropriation, withholding, deduction, arrears of urban subsistence allowances;

(three) failing to apply for urban subsistence allowances according to the prescribed examination and approval procedures;

(four) dereliction of duty, abuse of power, corruption, bribery, affecting the normal work of urban subsistence allowances, resulting in adverse social impact;

(five) issued false certification materials;

(six) enjoy the treatment of urban subsistence allowances and collect the cost of making capital for them.

Article 28 If a person who enjoys the treatment of urban subsistence allowances commits one of the following acts, the district civil affairs department shall give him criticism and education or give him a warning, and recover the urban subsistence allowances he defrauded or impersonated; If the circumstances are bad, a fine of 1 times or 3 times the total value of urban minimum living security shall be imposed:

(a) take false, conceal the actual income of the family or issue false certificates and other means to cheat to enjoy the urban minimum living allowance;

(two) during the period of enjoying the urban subsistence allowance, the family income has improved, and the management examination and approval authority or the entrusted management organization has not been informed in accordance with the regulations, and continues to enjoy the urban subsistence allowance.

Twenty-ninth interference, destruction of urban minimum living security work order, threats, insults, beatings of urban minimum living security management staff, the public security department shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirtieth urban residents who are dissatisfied with the decision made by the civil affairs department not to approve the enjoyment of urban subsistence allowances or to reduce or stop the issuance of urban subsistence allowances, or the administrative punishment given, may apply for administrative reconsideration according to law; If you are still dissatisfied with the decision of administrative reconsideration, you may bring an administrative lawsuit according to law.
