Regulations of Liaoyuan Municipality on the Protection of Drinking Water Sources in Yangmu Reservoir
Chapter I General Provisions Article 1 In order to strengthen the protection of drinking water sources in Yangmu Reservoir, improve the environmental quality of drinking water, and ensure the safety of drinking water, these Regulations are formulated in accordance with the People's Republic of China (PRC) Water Law, the People's Republic of China (PRC) Water Pollution Prevention Law, the Regulations on the Protection of Drinking Water Sources in Cities and Towns in Jilin Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 Organizations and individuals engaged in activities related to the water environmental quality of drinking water sources in Yangmu Reservoir (hereinafter referred to as water sources) shall abide by these regulations. Article 3 The protection of water sources shall adhere to the principle of giving priority to protection, and the development and utilization shall be subordinated to protection to ensure the safety of drinking water. Article 4 The people's governments of Liaoyuan City, dongliao county and Longshan District (hereinafter referred to as cities, counties and districts) shall be responsible for the environmental quality of water sources within their respective administrative areas, and assess and evaluate the water source protection work of the people's governments at lower levels and the relevant departments of the people's governments at the corresponding levels and their responsible persons. Article 5 The municipal, county and district people's governments shall incorporate water source protection into the national economic and social development plan, rationally arrange and timely adjust the industrial structure and construction project planning in the areas around water sources according to the requirements of water source protection, and promote the coordinated development of economic construction and water source protection. Article 6 The municipal, county and district people's governments shall set up special funds for water source protection or increase financial funds for water source protection, which shall be used for water source protection projects and compensation mechanism construction, pollution prevention and control, supervision and management. Article 7 The competent department of environmental protection of the people's governments of cities and counties shall be responsible for the environmental protection of water sources, implement unified supervision and management on the prevention and control of water source pollution, formulate plans for the prevention and control of water source pollution, supervise and inspect the discharge of pollutants from water sources and their surrounding areas, and investigate and punish acts of water source pollution according to law.

The water administrative departments of the people's governments of cities, counties and districts shall be responsible for the supervision and management of water sources, water projects, water resources, soil and water conservation and fisheries.

Other relevant departments of the municipal, county and district people's governments shall be responsible for other work related to water source protection according to their respective responsibilities. Article 8 The municipal, county and district people's governments shall organize publicity on water source protection and popularize laws, regulations and scientific knowledge on water source protection.

Television, newspapers, radio and other news media should carry out public welfare publicity on water source protection to raise public awareness of water source protection. Article 9 All organizations and individuals have the obligation to protect water sources and have the right to stop and report acts of water pollution.

Organizations and individuals that have made remarkable achievements or provided important information in protecting water sources and avoiding serious pollution of water sources shall be commended or rewarded by the Municipal People's Government or relevant departments. Chapter II Protection Measures Article 10 The drinking water source protection area of Yangmu Reservoir (hereinafter referred to as the protection area) is divided into first-class protection areas and second-class protection areas. Specific areas outside the protected areas are designated as quasi-protected areas. Eleventh protected areas, quasi protected areas of water environment quality standards, in accordance with state regulations. Article 12 The Municipal People's Government shall establish a compensation mechanism for water source protection, and compensate organizations and individuals whose interests are affected by water source protection, including moving out of livestock and poultry farms and breeding communities in protected areas and quasi-protected areas, stopping crop planting, and implementing organic crop planting to develop ecological agriculture. Article 13 The municipal, county and district people's governments and their agricultural departments shall promote the transfer of cultivated land to organizations and individuals that implement agricultural organic cultivation in protected areas, support the development of large-scale ecological agriculture, and guide crop growers to apply non-chemical synthetic fertilizers, pesticides and crop growth regulators; Popularize soil testing and formula fertilization and integrated pest control of crops in quasi-protected areas. Article 14 The municipal, county and district people's governments shall take engineering measures or build water conservation forests, constructed wetlands and other ecological protection measures in protected areas and quasi-protected areas to prevent water pollutants from being directly discharged into water sources. Fifteenth counties, districts and towns where protected areas and quasi-protected areas are located are responsible for the following work in protected areas and quasi-protected areas:

(a) planning the setting of toilets in accordance with the prescribed standards, and conducting supervision and management;

(two) the collection, transportation and harmless treatment of domestic garbage and sewage;

(three) the use of technical measures to temporarily pile up garbage to prevent groundwater pollution caused by rainfall and leakage.

If the funds required to carry out the work listed in the preceding paragraph of this article are insufficient, the Municipal People's Government shall pay from the funds for water source protection. Sixteenth protected areas and quasi protected areas prohibit the following acts:

(a) the construction of chemical, paper, coking, pharmaceutical, tanning, electroplating, printing and dyeing, oil refining, metallurgy and other construction projects that seriously pollute the water body;

(two) reconstruction projects to increase the amount of sewage;

(three) destruction of water conservation forests, revetment forests, deforestation, unauthorized felling of trees;

(four) other acts that seriously affect the quality of water environment. Seventeenth in the protected area, it is forbidden to build, rebuild and expand livestock and poultry farms and breeding communities, and the original farms and breeding communities should be moved out according to law.

Family farming of livestock and poultry in protected areas must conform to the standards of breeding types and quantity stipulated by the Municipal People's Government and be kept in captivity. Eighteenth vehicles transporting toxic substances and dangerous chemicals are not allowed to enter the protected area.

The public security and transportation departments of the people's governments of cities and counties shall take engineering and technical measures such as setting no-go signs, adjusting traffic routes and restricting traffic to ensure the implementation of the provisions of the preceding paragraph of this article.
