(a) the national key protected wild animals announced by the State Council;
(two) the provincial key protected wild animals announced by the Guangdong Provincial People's Government;
(3) Terrestrial wild animals that are beneficial or have important ecological, scientific and social values announced by the forestry administrative department of the State Council.
The provisions of the preceding paragraph can be raised in large quantities after successful artificial propagation according to law, except for those that are allowed to eat after passing the inspection and quarantine by the national or provincial forestry and fishery administrative departments. The term "wildlife products" as mentioned in these Provisions refers to any part of wildlife and its derivatives. Third catering operators and other units and individuals shall not operate, process and sell wild animals and their products that are prohibited from eating. Article 4 Catering operators shall not make signboards or make recipes to attract and induce customers by using the names, nicknames and patterns of wild animals and their products that are forbidden to eat. Article 5 The administrative departments of forestry and fishery of the municipal and district people's governments and the administrative departments for industry and commerce shall, in accordance with their respective responsibilities, cooperate and investigate and deal with the acts of processing, selling and eating wild animals and their products according to law. Public security, urban management, quarantine and other departments should support and cooperate.
The administrative departments of forestry and fishery and the administrative departments for industry and commerce may detain and seal up wild animals and their products when investigating and dealing with violations of these provisions. Take detention and sealing measures, the longest shall not exceed fifteen days. The relevant competent departments shall properly keep the detained wild animals. Article 6 The administrative departments of forestry and fishery of the Municipal People's Government shall be responsible for the protection, breeding, release, reception and transfer of wild animals.
The government encourages, guides and supervises units and individuals to carry out wildlife protection and rescue work according to law. Article 7 The municipal and district people's governments, educational institutions and social organizations shall strengthen publicity and education on wildlife protection, the news media shall promptly expose the illegal consumption of wildlife, and the administrative departments of forestry and fishery shall promptly forward and publish the list of wildlife protection. Eighth acts in violation of the provisions, given the following penalties:
(a) in violation of the provisions of Article 2, the administrative departments of forestry and fishery shall impose a fine of 1000 yuan on each consumer and a fine of 2000 yuan to 10000 yuan on the organized consumers;
(two) in violation of the provisions of article third, the administrative department of forestry and fishery or the administrative department for Industry and Commerce shall confiscate the real objects and illegal income, and impose a fine of not less than twenty thousand yuan but not more than one hundred thousand yuan;
(three) in violation of the provisions of article fourth, the administrative department for Industry and Commerce shall order it to make corrections within a time limit; If it is not corrected within the time limit, it will be forcibly removed and confiscated, and a fine of 1000 yuan to 5000 yuan will be imposed. Ninth reports of illegal processing, sale and consumption of wild animals, which are verified, shall be rewarded by the administrative departments of forestry and fishery or the administrative departments for industry and commerce. Specific measures shall be formulated by the Municipal People's Government. Article 10 If the staff of forestry and fishery administrative departments, industrial and commercial administrative departments and other relevant departments neglect their duties, abuse their powers, engage in malpractices for selfish ends, cover up or condone illegal acts, or refuse to receive, rescue, raise, release or hand over the confiscated, detained or transferred wild animals, they shall be given administrative sanctions by their units or the higher authorities; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 11 These Provisions shall come into force as of June 1 day, 2003.
