Garrison Law of People's Republic of China (PRC) Special Administrative Region
Chapter I General Provisions Article 1 This Law is formulated in accordance with the Constitution and the Basic Law of the Hong Kong Special Administrative Region in order to ensure that the troops of the Central People's Government stationed in the Hong Kong Special Administrative Region responsible for defense perform their duties according to law and safeguard the sovereignty, unity and territorial integrity of the country and the security of Hong Kong. Article 2 The troops of the Central People's Government stationed in the Hong Kong Special Administrative Region for defense are composed of the PLA Army, Navy and Air Force, and are called the China People's Liberation Army Hong Kong Garrison. Article 3 The Hong Kong Garrison shall be led by People's Republic of China (PRC) the Central Military Commission (CMC), and the number of garrison posts shall be determined according to the national defense needs of the Hong Kong Special Administrative Region.

The Hong Kong Garrison implements a personnel rotation system. Article 4 The expenses of the Hong Kong Garrison shall be borne by the Central People's Government. Chapter II Duties of the Hong Kong Garrison Article 5 The Hong Kong Garrison shall perform the following defense duties:

(1) To guard against and resist aggression and safeguard the security of the Hong Kong Special Administrative Region;

(2) Undertaking the obligation of defense;

(3) Managing military facilities;

(4) To undertake relevant foreign-related military affairs. Article 6 When the NPC Standing Committee decides to declare a state of war or decide that the Hong Kong Special Administrative Region is in a state of emergency due to turmoil beyond the control of the Government of the Hong Kong Special Administrative Region that endangers national unity or security, the Hong Kong Garrison shall perform its duties in accordance with the provisions of the national laws decided by the Central People's Government to be implemented in the Hong Kong Special Administrative Region. Article 7 Law enforcement officers of the Hong Kong Special Administrative Region shall not inspect, search or detain aircraft, ships and other weapons, equipment and materials of the Hong Kong Garrison, as well as personnel and vehicles holding certificates or certificates issued by the Hong Kong Garrison to perform their duties.

The Hong Kong Garrison and members of the Hong Kong Garrison also enjoy other rights and immunities stipulated by the existing laws of the Hong Kong Special Administrative Region. Article 8 Members of the Hong Kong Garrison may take measures to stop acts that hinder them from performing their duties in accordance with the existing laws of the Hong Kong Special Administrative Region. Chapter III Relations between the Hong Kong Garrison and the Government of the Hong Kong Special Administrative Region Article 9 The Hong Kong Garrison shall not interfere in the local affairs of the Hong Kong Special Administrative Region. Article 10 The Government of the Hong Kong Special Administrative Region shall support the Hong Kong Garrison in performing its defense duties and safeguard the legitimate rights and interests of the Hong Kong Garrison and its personnel.

When formulating policies and drafting bills involving the Hong Kong Garrison, the Hong Kong Special Administrative Region shall solicit the opinions of the Hong Kong Garrison. Article 11 The Hong Kong Garrison shall notify the Government of the Hong Kong Special Administrative Region in advance of any military activities involving the public interests of the Region, such as training and exercises. Article 12 The Hong Kong Garrison and the Government of the Hong Kong Special Administrative Region shall jointly protect the military installations of the Hong Kong Special Administrative Region.

The Hong Kong Garrison shall, together with the Government of the Hong Kong Special Administrative Region, designate a military restricted zone. The location and scope of the military restricted zones shall be announced by the government of the Hong Kong Special Administrative Region.

The Government of the Hong Kong Special Administrative Region shall assist the Hong Kong Garrison in maintaining the security of the military restricted zones.

Without the approval of the Supreme Commander of the Hong Kong Garrison or an officer authorized by him, personnel, vehicles, ships and aircraft outside the Hong Kong Garrison are not allowed to enter the military restricted zone. Security personnel in the military restricted zone have the right to stop unauthorized entry into the military restricted zone and damage or endanger military facilities according to law.

The Hong Kong Garrison shall, in accordance with the laws of the Hong Kong Special Administrative Region, protect the natural resources, cultural relics and historical sites and non-military rights and interests in the military restricted zones. Article 13 If the military land of the Hong Kong Garrison is no longer used for national defense purposes with the approval of the Central People's Government, it shall be handed over to the government of the Hong Kong Special Administrative Region free of charge.

If the government of the Hong Kong Special Administrative Region needs to use part of the military land of the Hong Kong Garrison for public purposes, it must obtain the approval of the Central People's Government; After approval, the government of the Hong Kong Special Administrative Region will provide the Hong Kong Garrison with military land and military facilities at the location agreed by the Central People's Government, and bear all the expenses. Article 14 In accordance with the provisions of the Basic Law of the Hong Kong Special Administrative Region, the Government of the Hong Kong Special Administrative Region may, when necessary, request the assistance of the Hong Kong Garrison in maintaining public order and rescuing disasters.

After the request of the Government of the Hong Kong Special Administrative Region is approved by the Central People's Government, the Hong Kong Garrison will send troops to assist in maintaining public order and emergency rescue and disaster relief according to the order of the Central Military Commission, and return to the station after completing the task.

When the Hong Kong Garrison assists in maintaining public order and rescuing disasters, it shall be under the command of the Supreme Commander of the Hong Kong Garrison or an official authorized by him under the arrangement of the Government of the Hong Kong Special Administrative Region.

Members of the Hong Kong Garrison shall exercise the powers prescribed by the laws of the Hong Kong Special Administrative Region when assisting in maintaining social order and rescuing disasters. Article 15 The Hong Kong Garrison and the Government of the Hong Kong Special Administrative Region shall establish necessary contacts and handle matters related to the Garrison through consultation. Chapter IV Obligations and Discipline of Members of the Hong Kong Garrison Article 16 Members of the Hong Kong Garrison shall perform the following obligations:

(a) be loyal to the motherland, perform their duties, safeguard the security, honor and interests of the motherland, and safeguard the security of Hong Kong;

(2) Abide by national laws and laws of the Hong Kong Special Administrative Region, and observe military discipline;

(3) respecting the organs of political power of the Hong Kong Special Administrative Region and the social system and lifestyle of the Region;

(4) Take care of the public property of the Hong Kong Special Administrative Region and the private property of Hong Kong residents and others;

(5) Abide by social morality and pay attention to etiquette.
