(1) Wild animals under special state protection and other terrestrial wild animals that naturally grow and breed in the wild environment;
(2) Terrestrial wild animals artificially propagated and raised.
It is forbidden to use animals and their products for non-edible purposes such as scientific experiments, public display and pet keeping. Article 3 Edible animals include:
(1) Pigs, cattle, sheep, donkeys, rabbits, chickens, ducks, geese, pigeons and quails listed in the National Catalogue of Livestock and Poultry Genetic Resources and other poultry and livestock raised for the purpose of providing the food listed in the Catalogue;
(2) Aquatic animals not prohibited by laws and regulations. Article 4. No unit or individual may produce or market animals and their products that are prohibited for consumption. Article 5 No unit or individual may provide places or trading services for the production and operation of animals and their products that are prohibited from eating. Article 6 No unit or individual may raise animals that are forbidden to eat for the purpose of providing food; Breeding for non-edible purposes such as scientific experiments, public exhibitions and pet breeding shall be carried out in accordance with the provisions of relevant laws and regulations. Article 7 No unit or individual may publish advertisements to publicize and induce the consumption of prohibited animals and their products, and may not use the names, nicknames and patterns of prohibited animals and their products to make catering signs or recipes. Article 8 Edible animals and their products prohibited from being used as medicine shall abide by the laws and regulations on drug administration.
It is forbidden to eat in the name of medicated diet or to produce or market animals and their products that are prohibited from eating. Article 9 Promote the cold chain distribution of edible animals.
The following acts are prohibited:
(1) Slaughtering poultry and livestock without permission;
(2) selling slaughtered poultry and livestock without permission;
(3) selling live poultry and livestock to consumers for the purpose of providing food. Article 10 The municipal and district people's governments shall comprehensively strengthen their leadership over the work of prohibiting the consumption of wild animals, organize and urge relevant departments to perform their supervisory duties according to law, strengthen coordination and cooperation, and intensify supervision and inspection and accountability. Eleventh planning and natural resources departments are responsible for the supervision and management of wildlife protection, artificial breeding, artificial breeding and other activities and operational guidance.
The market supervision department is responsible for the supervision and management of the production, operation, advertising and other activities of prohibited animals and their products in commodity trading, catering and other places and online trading platforms, as well as the behavior of eating prohibited animals and their products.
The urban management comprehensive law enforcement department is responsible for the supervision and management of the activities of mobile vendors and animals and their products prohibited from being eaten in temporary trading places.
Education, public security, health, customs and other departments shall, in accordance with their respective responsibilities, do a good job in the implementation of these regulations. Twelfth relevant departments, schools at all levels, people's organizations, social organizations, news media, etc. We should actively carry out publicity and education on the total prohibition of eating wild animals. Article 13 All citizens should enhance their awareness of ecological environmental protection and public health and safety, resolutely give up the bad habit of eating wild animals, and develop a scientific, healthy and civilized lifestyle. Fourteenth in violation of the provisions of this Ordinance, any unit or individual has the right to complain and report to the relevant departments. Fifteenth licensed in the Shenzhen Special Economic Zone to engage in wildlife breeding, because of the implementation of this Ordinance, the administrative license is revoked or changed, the municipal and district people's governments shall compensate according to law. Sixteenth in restaurants, restaurants, canteens and other places in violation of the provisions of Article 2 of these regulations, the market supervision department shall order it to stop the illegal behavior, confiscate the animals and their products, and impose a fine in accordance with the following provisions:
(1) Those who knowingly eat wild animals and their products under special state protection shall be fined between five times and thirty times the per capita value, and those who organize eating shall be given a heavier punishment;
(2) Those who knowingly eat animals and their products that are forbidden to eat except wildlife under special state protection shall be fined between two times and ten times the value of each consumer, and those who organize eating shall be given a heavier punishment.
Whoever violates the provisions of Article 2 of these regulations outside the places specified in the preceding paragraph shall be punished in accordance with the provisions of relevant laws and regulations. Seventeenth in violation of the provisions of article fourth of this Ordinance, the comprehensive law enforcement departments of market supervision and urban management shall be ordered to stop the illegal behavior in accordance with the division of responsibilities, confiscate the animals and their products and illegal income, and impose a fine in accordance with the following provisions; If the circumstances are serious, the relevant license shall be revoked according to law:
(a) for the purpose of providing food, the production and operation of wildlife under special state protection and its products, the value of which is less than 1 10,000 yuan, shall be fined between 1 50,000 yuan and 200,000 yuan, and the value of which is more than110,000 yuan shall be fined between 20 times and 30 times;
(2) For the purpose of providing food, if the production and operation of animals and their products that are prohibited from eating except wild animals under special state protection, or the value of the goods is less than 1 10,000 yuan, a fine of more than110,000 yuan and less than150,000 yuan shall be imposed; If the value of goods is more than 1 10,000 yuan, a fine of more than 15 times and less than 20 times shall be imposed.
