Methods for value evaluation of aquatic wildlife and their products

Article 1: In order to standardize the value assessment methods and standards for aquatic wildlife and their products, these measures are formulated in accordance with the "Wildlife Protection Law of the People's Republic of China". Article 2 These Measures shall apply to the assessment of the value of rare and endangered aquatic wild animals and their products protected under the Wildlife Protection Law of the People’s Republic of China.

The aquatic wildlife specified in these Measures refers to the aquatic wildlife under national key protection and the aquatic species listed in the Appendix of the Convention on International Trade in Endangered Species of Wild Fauna and Flora as a whole (including eggs).

The aquatic wildlife products specified in these Measures refer to the parts of aquatic wildlife and their derivatives. Article 3 The overall adult value of aquatic wild animals is calculated based on the benchmark value of the corresponding species multiplied by the protection level coefficient.

The Ministry of Agriculture and Rural Affairs is responsible for formulating, publishing and adjusting the "Aquatic Wildlife Benchmark Value Standard Catalog". Article 4 The protection level coefficient of aquatic wildlife under first-level national protection is 10. The protection level coefficient of national second-level key protected aquatic wildlife is 5.

If the aquatic species listed in the appendix of the Convention on International Trade in Endangered Species of Wild Fauna and Flora have been approved by the Ministry of Agriculture and Rural Affairs as national key protected wild animals, their value will be calculated according to the corresponding protection level coefficient; For wild animals approved by the Ministry of Education as national key protected animals, the protection level coefficient is 1. Article 5 The overall value of juvenile aquatic wild animals is calculated based on the overall adult value of the species multiplied by the development stage coefficient.

The development stage coefficient should not exceed 1, and should be determined by the law enforcement agency or evaluation agency that calculates its value by comprehensively considering the species' fecundity, survival rate, development stage and other actual conditions. Article 6 The value of aquatic wild animal eggs, if there is a separate benchmark value, shall be calculated based on the benchmark value multiplied by the protection level coefficient; if there is no separate benchmark value, the value shall be calculated based on the overall adult value of the species multiplied by the fecundity coefficient.

The fecundity coefficient of reptile wild animal eggs is one tenth; the fecundity coefficient of amphibian wild animal eggs is one thousandth; the fecundity coefficient of invertebrate and fish wild animal eggs is comprehensive Determination takes into account the fecundity and survival rate of the species. Article 7 The value of aquatic wildlife products is calculated based on the overall value of the species multiplied by the coefficient of the part involved in the case.

The coefficient of the part involved should not exceed 1; if it is the main utilized part of the species, the coefficient of the part involved should not be less than 0.7. The specific determination shall be determined by the law enforcement agency or evaluation agency that calculates the value, taking into account factors such as the utilization part of the product and the degree of harm to animals. Article 8 The value of artificially bred aquatic wild animals and their products shall be calculated based on the value calculated in accordance with Articles 3 to 7 of these Measures multiplied by the species source coefficient.

For artificially bred individuals and their products that are included in the list of artificially bred national key protected aquatic wildlife species, the species origin coefficient is 0.25; for artificially bred individuals and their products of other species, the species origin coefficient is 0.5. Article 9 If there is an actual transaction price for aquatic wildlife and its products, and the actual transaction price is higher than the value assessed in accordance with these Measures, the actual transaction price shall prevail. Article 10 After the implementation of these Measures, aquatic wild animals that are newly listed in the "List of National Key Protected Wild Animals" or the appendix of the "Convention on International Trade in Endangered Species of Wild Fauna and Flora" but have not yet been included in the "Catalogue of Benchmark Value Standards for Aquatic Wild Animals", Its benchmark value is calculated with reference to the benchmark value of the most closely similar aquatic wild animal of the same genus, family or purpose. Article 11 The value of local key protected aquatic wildlife that is not included in the appendix of the Convention on International Trade in Endangered Species of Wild Fauna and Flora can be calculated with reference to these methods, and the protection level coefficient can be calculated as 1. Article 12 These Measures shall come into effect on October 1, 2019.
