Medical expenses Medical expenses include the registration fee, examination fee, treatment fee, surgical fee, medical fee, hospitalization fee, rehabilitation fee, plastic surgery fee and follow-up treatment paid by the person concerned for the treatment of injuries and illnesses. The amount of compensation for medical expenses = the amount of medical treatment + the amount of medicine + the amount of hospitalization service meal allowance, the amount of compensation for hospital meal allowance = the standard meal allowance for business trip (yuan/person/day) * 70% * the number of days transportation and accommodation costs According to the person concerned and the necessary accompanying staff for medical treatment or transfer to the hospital for treatment, the actual incurred transportation and accommodation costs. Nutritional expenses Nutritional expenses refer to the expenses incurred by the person concerned for purchasing nutritional supplements other than daily diet to support treatment or to enable the person to recover as soon as possible. Nutritional expenses shall be determined according to the degree of disability of the person concerned with reference to the opinion of the hospital and the proof of expenditure on nutritional expenses. Article 25(1) of the Interpretation of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Personal Injury Compensation Cases stipulates that "disability compensation shall be calculated in accordance with the degree of the victim's loss of working ability or the grade of disability, and in accordance with the standard of the per capita disposable income of the urban residents or the per capita net income of the rural residents of the place where the court under appeal is located in the preceding year, and shall be calculated at a rate of 20 years from the date of the determination of the disability. The compensation shall be calculated over a period of twenty years from the date of determination of the disability. However, for those over sixty years of age, the period shall be reduced by one year for each additional year of age; and for those over seventy-five years of age, the period shall be calculated at five years." The formula for its calculation is: disability compensation = per capita income of residents in the previous year in the place where the court under appeal is located × disability coefficient × years of compensation
