Tensil Group has authorized China Red Bull to produce and sell Red Bull series of beverages in China under a joint venture partnership since 1998.After the expiration of the authorization on October 6, 2016, China Red Bull did not stop production and sales, for which Tensil Group initiated a trademark infringement lawsuit, and China Red Bull initiated a dispute over the ownership of the trademark in the Beijing Municipal Higher People's Court.
On November 25, 2019, the Beijing Higher People's Court issued a first-instance decision rejecting all of China Red Bull's requests to confirm that it "enjoys the legitimate rights and interests of the owner" and to require the Tens Group to pay it 3.753 billion yuan in advertising fees. China Red Bull then appealed to the Supreme People's Court of the People's Republic of China ("Supreme Court").
On June 24, 2019, a lawsuit filed by Thailand's Tens Pharmaceutical and Healthcare Company Limited against China Red Bull's manufacturers and sellers was dismissed by the Zhejiang Higher People's Court in accordance with the law.
On December 21, 2020, the Supreme Court issued a final judgment on a dispute over the ownership of the Red Bull series of trademarks between China Red Bull and TENCEL Group, rejecting China Red Bull's appeal and upholding the first-instance judgment, which made it clear that TENCEL Group is the owner of the Red Bull series of trademarks.
