Article 10: Applications for food business licenses shall be submitted according to the classification of food business entities and business projects.
The main food business formats are food sales operators, catering service operators, and unit canteens. Food operators that apply to operate online, establish central kitchens, or engage in collective meal delivery should be marked in parentheses after the main business format.
Food business projects are divided into prepackaged food sales (including refrigerated frozen food, excluding refrigerated frozen food), bulk food sales (including refrigerated frozen food, excluding refrigerated frozen food), special food sales (health care Sales of food, formula foods for special medical purposes, infant formula milk powder, other infant formula foods), and other types of food; manufacturing and selling of hot food, cold food, raw food, and pastry food. , production and sales of homemade drinks, production and sales of other types of food, etc.
Specific varieties included in other food sales and other food production and sales must be reported to the State Food and Drug Administration for approval before implementation, and be clearly marked. Foods that are hot, cold, raw, solid, liquid, etc. and difficult to be clearly classified can be classified according to the situation with the highest food safety risk level.
The State Food and Drug Administration may adjust the categories of food business projects based on the needs of supervision and management work.
Article 11 To apply for a food business license, you must meet the following conditions:
(1) Have food raw material handling and food processing and sales capabilities that are commensurate with the variety and quantity of food being operated. , storage and other places, keep the environment of the place clean and tidy, and keep a specified distance from toxic, harmful places and other pollution sources;
(2) Have operating equipment or facilities suitable for the variety and quantity of food being operated , have corresponding equipment or facilities for disinfection, changing, washing, lighting, lighting, ventilation, anti-corrosion, dust-proof, fly-proof, rodent-proof, insect-proof, washing, wastewater treatment, garbage and waste storage;
(3) Have full-time or part-time food safety management personnel and rules and regulations to ensure food safety;
(4) Have reasonable equipment layout and process flow to prevent food to be processed from being directly imported from food and raw materials Cross-contamination with finished products and avoid food contact with toxic substances and unclean substances;
(5) Other conditions stipulated by laws and regulations.
Article 12 To apply for a food business license, the following materials shall be submitted to the local food and drug supervision and administration department at or above the county level where the applicant is located:
(1) Application form for food business license;
(2) Copies of business license or other entity qualification documents;
(3) Documents such as the layout and operating procedures of major equipment and facilities suitable for food operations;
(4) Food safety self-examination, employee health management, purchase inspection records, food safety accident handling and other rules and regulations to ensure food safety.
If automatic vending equipment is used to sell food, the applicant shall also submit the product qualification certificate of the automatic vending equipment, the specific placement location, the operator's name, address, contact information, and publicity of the food business license methods and materials.
If the applicant entrusts another person to apply for a food business license, the agent shall submit a power of attorney and the agent's identity document.
Article 13: The applicant shall truthfully submit relevant materials and reflect the true situation to the food and drug supervision and administration department, be responsible for the authenticity of the application materials, and sign or stamp the application form and other materials.
