Twenty-sixth travel agencies and their branches and service outlets shall hang the Travel Agency Business License, the Travel Agency Branch Registration Certificate or the Travel Agency Service Network Registration Certificate together with the business license in a prominent position in the business premises.
Twenty-seventh travel agency business license shall not be transferred, leased or lent.
The following acts of travel agencies belong to the act of transferring, leasing or lending the business license of travel agencies:
(1) Allowing or acquiescing other enterprises, groups or individuals to engage in the business activities of travel agencies in their own names, except for soliciting tourists and receiving tourists in accordance with the provisions of the first paragraph of Article 34 of these Rules;
(two) allow other enterprises, organizations or individuals to operate travel agency business by contracting or linking departments or individuals.
Twenty-eighth offices, representative offices or liaison offices established by travel agencies shall not engage in the business activities of travel agencies.
Twenty-ninth travel agencies to operate travel agency business in the form of the Internet, in addition to complying with the provisions of laws and regulations, the home page of its website should indicate the name of the travel agency, legal representative, license number and business scope, as well as the complaint telephone number of the original licensed tourism administrative department.
Thirtieth "Regulations" provisions of Article 26 of the travel agency shall not arrange activities, mainly including:
(1) Content that harms national interests and national dignity;
(2) Containing ethnic, racial and religious discrimination;
(3) Containing obscene, gambling and drug-related contents;
(four) other contents in violation of laws and regulations.
Article 31 A travel agency as stipulated in Article 34 of the Regulations shall not require tour guides and tour leaders to bear the related expenses for receiving tourist teams, mainly including:
(1) Prepaid travel reception fee;
(two) to pay the travel agency the cost of receiving the tourism team;
(3) Other unreasonable expenses.
Thirty-second travel agencies to attract, organize and receive tourists, the choice of transportation, accommodation, catering, scenic spots and other enterprises should meet the requirements of legitimate business qualifications and reception service capabilities.
Article 33 When signing a travel contract, a travel agency shall not require tourists to participate in shopping activities arranged by the travel agency or travel projects that require tourists to pay separately.
In the same tourism team, the travel agency shall not propose different contract items from other tourists due to the following factors:
(a) tourists refuse to participate in shopping activities arranged by travel agencies or travel projects that require tourists to pay separately;
(2) Differences in age or occupation of tourists. But travel agencies provide more services than other tourists, unless tourists take the initiative to ask.
Article 34 Where a travel agency needs to entrust the business of receiving tourists at a tourist destination, it shall entrust the travel agency of the tourist destination in accordance with the provisions of Article 36 of the Regulations and sign an entrustment reception contract.
Where a travel agency entrusts the business of receiving tourists, it shall inform the tourists of the name, address, contact person and telephone number of the travel agency entrusted by the tourist destination in accordance with the provisions of Article 36 of the Regulations.
Thirty-fifth before the start of tourism, when the agreed travel contract is terminated, with the consent of the tourists, the travel agency can recommend the tourists to other travel agencies to organize reception, and the tourists will sign a travel contract with the recommended travel agency.
Without the consent of tourists, travel agencies may not transfer tourists to other travel agencies for reception.
Thirty-sixth travel agencies and their appointed tour guides and tour leaders commit the following acts, which belong to changing the travel contract to arrange the itinerary without authorization:
(a) reduce the number of sightseeing items or shorten the time of sightseeing;
(2) Adding or changing tourism projects;
(three) increase the number of shopping or extend the shopping time;
(four) other acts of changing the travel contract arrangement without authorization.
Article 37 In case of force majeure, endangering the personal and property safety of tourists or accidents not caused by the travel agency, when the travel agency needs to adjust or change the itinerary agreed in the travel contract, it shall explain to the tourists in advance; If it is really impossible to explain in advance due to objective circumstances, it shall be explained afterwards.
Thirty-eighth in the travel itinerary, tourists have the right to refuse to participate in shopping activities outside the travel contract arranged by the travel agency or travel projects that require tourists to pay separately.
Travel agencies and their appointed tour guides and tour leaders shall not refuse to continue to perform the contract or provide services for any excuse or reason, and shall not threaten to refuse to continue to perform the contract or provide services on the grounds that tourists refuse to participate in shopping activities arranged by travel agencies or travel projects that require tourists to pay separately.
Thirty-ninth travel agencies and their appointed tour guides and tour leaders shall make true explanations and clear warnings to tourists about matters that their services may endanger the personal and property safety of tourists.
During the free time in the travel itinerary, tourists should choose the activities in which they can control risks and the activities in which they can control risks.
Fortieth in order to reduce the damage caused by natural disasters and other unexpected risks to tourists, travel agencies can prompt tourists to buy travel accident insurance when attracting and receiving tourists.
Encourage travel agencies to obtain insurance agency qualifications according to law, accept the entrustment of insurance companies, and provide services for tourists to buy personal accident insurance.
Forty-first outbound tourists illegally staying abroad or inbound tourists illegally staying in China, the travel agency shall immediately report to the local tourism administrative departments at or above the county level, public security organs and foreign affairs departments.
Forty-second in the travel itinerary, travel agencies and their appointed tour guides and tour leaders should remind tourists to abide by civilized tourism conventions and etiquette.
Forty-third travel agencies and their appointed tour guides and tour leaders enjoy the following rights in their operations and services:
(a) require tourists to truthfully provide personal information necessary for travel and submit relevant documents on time;
(two) require tourists to abide by the travel itinerary agreed in the travel contract and take care of their own property;
(3) In case of public emergencies or other critical situations, when the travel agency takes remedial measures against the violation of the travel contract, it requires the tourists to cooperate with it to prevent the loss from expanding and minimize the loss;
(4) Refusing unreasonable demands put forward by tourists beyond those stipulated in the travel contract;
(five) to stop the words and deeds of tourists who violate the laws and customs of tourist destinations.
Forty-fourth travel agencies should properly keep all kinds of contracts and related documents and materials for soliciting, organizing and receiving tourists as stipulated in the Regulations for inspection by tourism administrative departments at or above the county level.
The retention period of the contracts, documents and materials mentioned in the preceding paragraph shall not be less than two years.
Travel agencies shall not disclose the personal information provided by tourists for signing travel contracts to other operators or individuals; Personal information of tourists beyond the shelf life shall be properly destroyed.
