Measures of Fushun Municipality on the Administration of Controlling Atmospheric Non-point Source Pollution

chapter I general provisions article 1 these measures are formulated in accordance with the law of the people's Republic of China on the prevention and control of air pollution and other relevant laws and regulations, combined with the actual situation of our city, in order to strengthen the supervision and management of atmospheric non-point source pollution in urban areas, improve the ambient air quality and ensure human health. Article 2 The atmospheric non-point source pollution mentioned in these Measures refers to the pollution caused by various pollutants discharged into the atmosphere at a low altitude of less than 31 meters, mainly including: coal-fired boilers, tea bath stoves, cooking stoves, coal-fired smoke and soot, dust from construction, dust from coal yards, mines, material piles and ash piles, dust from motor vehicle transportation, tail gas from motor vehicles, etc. Article 3 These Measures shall apply to the management of atmospheric non-point source pollution in urban planning areas. Article 4 The municipal environmental protection administrative department shall exercise unified supervision and management over the prevention and control of atmospheric non-point source pollution in the whole city.

the competent administrative department of environmental protection of each district (including Fushun county) shall supervise and manage the prevention and control of atmospheric non-point source pollution within its jurisdiction.

Public security, transportation and other relevant administrative departments at all levels shall supervise and manage the prevention and control of motor vehicle exhaust pollution according to their respective responsibilities.

all relevant administrative departments shall supervise and manage the prevention and control of atmospheric non-point source pollution within their respective responsibilities. Article 5 All units and individuals have the obligation to control atmospheric non-point source pollution, and have the right to report and accuse the units and individuals that pollute the atmospheric environment. Article 6 The government shall reward units and individuals that have made outstanding achievements in controlling atmospheric non-point source pollution. Chapter II Supervision and Administration Article 7 People's governments at all levels shall strengthen the prevention and control of atmospheric non-point source pollution, formulate prevention and control plans conducive to reducing atmospheric non-point source pollution, and adopt economic and technological policies and measures conducive to the prevention and control of atmospheric non-point source pollution.

the city's plan for promoting the use of clean energy is compiled by the municipal planning department, which organizes and guides all departments to implement it. Article 8 The government encourages the production and use of clean energy, promotes the technologies for controlling atmospheric non-point source pollution, clean burning appliances and clean fuels recognized by the state, provinces and municipalities, and promotes the use of clean fuel additives for motor vehicles.

the municipal economic management department should strengthen the supervision and inspection of the technology and equipment explicitly eliminated by the state and the province, and prohibit the use of backward technology and equipment. Chapter III Prevention and Control of Smoke and Dust Pollution Article 9 A number of loose coal burning areas are designated every year in the whole city, and it is strictly forbidden to use loose coal as fuel in the loose coal burning areas. Any unit or individual is prohibited from using coal with ash content greater than 31% and sulfur content greater than 1%.

It is forbidden to use loose coal as fuel for boilers and tea bath stoves with rated power of 611,111 kcal and less than 1.7 MW (1 tons/hour), and cooking stoves in catering services and canteens of various units, and clean fuels such as gas, liquefied petroleum gas, oil, electricity and briquette are all used.

units or individuals that produce and sell briquettes must meet the national or local standards. Article 11 No unit or individual may use boiler equipment explicitly eliminated by the state, and may not transfer the eliminated equipment to others for use. Eleventh where residential areas and traffic main roads on both sides of the boiler should strictly implement the provincial provisions of the emission standards of atmospheric pollutants, are not allowed to exceed the standard. The competent administrative department of environmental protection should strengthen the supervision and inspection of smoke emission from boilers, tea bath stoves and catering stoves in residential areas, and put an end to the phenomenon of black smoke. Article 12 The decentralized heating boilers in the central heating area shall be phased out within a time limit. For areas with joint heating conditions, joint heating shall be implemented. No new coal-fired heating boilers shall be built. In areas where central heating is temporarily implemented unconditionally, the smoke and dust emission of heating boilers must meet the emission standards stipulated by the state or province. Thirteenth heating boilers should adopt clean production technology to prevent smoke pollution. Fourteenth units and individuals that use boiler equipment must establish and improve the responsibility system for environmental protection, and environmental management personnel and firemen can only take up their posts after professional training by the environmental protection department. Fifteenth it is forbidden to burn linoleum, rubber, plastic, leather, garbage and other substances that produce toxic and harmful smoke and dust in the open air in densely populated areas.

it is forbidden to burn leaves, dried grass, orange stalks and other substances that produce smoke and dust in residential areas or near traffic trunk lines.

it is forbidden to boil asphalt in the open air in residential areas. Sixteenth catering service operators must take effective measures to prevent and control pollution, and the emission of lampblack shall not exceed the national and provincial standards, and it is forbidden to barbecue food in the open air. Chapter IV Prevention and Control of Motor Vehicle Exhaust Pollution Article 17 Motor vehicles produced and sold by any unit or individual must meet the national and provincial standards for pollutant discharge. Planning, public security and traffic management departments should strengthen the supervision and management of motor vehicles and strictly implement the motor vehicle scrapping system.
