Legal analysis: Before workers get compensation for work-related injuries, they must first appraise their ability to work, and then get corresponding compensation according to the appraisal level.

(1) treatment (medical) expenses. The expenses for the treatment of work-related injuries must conform to the catalogue of work-related injury insurance diagnosis and treatment items, the catalogue of work-related injury insurance drugs and the hospitalization service standard of work-related injury insurance.

(2) Hospitalization food allowance. If an employee is hospitalized for work-related injuries, the unit to which he belongs shall issue a hospital food subsidy according to 71% of the food subsidy standard of the unit on business trip.

(3) Transportation expenses and room and board expenses for medical treatment in other places. If the medical institution issues a certificate and reports it to the agency for approval, and the injured worker goes to the outside of the overall planning area for medical treatment, the required transportation, accommodation and expenses shall be reimbursed by the unit according to the standard of the employee's business trip.

(4) Rehabilitation treatment fee. The expenses of rehabilitation treatment for workers with work-related injuries to medical institutions that have signed service agreements shall be paid from the work-related injury insurance fund if they meet the requirements of the third paragraph of this article, such as the catalogue of work-related injury insurance diagnosis and treatment items, the catalogue of work-related injury insurance drugs and the hospitalization service standard of work-related injury insurance.

(5) Expenses for assistive devices. Workers with work-related injuries can install artificial limbs, orthotics, artificial eyes, dentures and wheelchairs and other auxiliary devices due to their daily life or employment needs, and the required expenses are paid from the work-related injury insurance fund according to the standards stipulated by the state.

(6) wages during shutdown with pay. If an employee suffers from an accident or occupational disease at work and needs to suspend work to receive work-related injury medical treatment, the original salary and welfare benefits will remain unchanged during the period of suspension with pay, and the unit where he works will pay him monthly.

(7) Living nursing expenses. If the injured workers who can't take care of themselves need nursing during the period of shutdown with pay, the unit where they work is responsible. Workers with work-related injuries who have assessed their disability levels and have been confirmed by the labor ability appraisal committee to need life care will be paid monthly from the work-related injury insurance fund. Life care fees are paid according to three different levels: life can't take care of itself at all, most of life can't take care of itself or part of life can't take care of itself, and their standards are 51%, 41% or 31% of the average monthly salary of employees in the overall planning area respectively.

(8) One-time disability allowance. The compensation standard of one-time disability allowance is determined according to the disability grade of the injured employee, and the compensation standard is different for different grades. The details are as follows:

First-class disability is my salary of 27 months, second-class disability is my salary of 25 months, third-class disability is my salary of 23 months, fourth-class disability is my salary of 21 months, fifth-class disability is my salary of 18 months, sixth-class disability is my salary of 16 months, seventh-class disability is my salary of 13 months, eighth-class disability is my salary of 11 months, and ninth-class disability is 9 months.

Article 38 The following expenses incurred due to work-related injuries shall be paid from the work-related injury insurance fund according to state regulations:

(1) Medical expenses and rehabilitation expenses for treating work-related injuries;

(2) food subsidies for hospitalization;

(3) transportation and accommodation expenses for medical treatment outside the overall planning area;

(4) the cost of installing and configuring assistive devices for the disabled;

(5) Life care expenses confirmed by the labor ability appraisal committee if the life cannot provide for itself;

(6) One-time disability allowance and monthly disability allowance for disabled employees of Grade I to IV;

(7) the one-time medical subsidy that should be enjoyed when the labor contract is terminated or dissolved;

(8) Funeral allowance, dependent relatives' pension and work-related death allowance received by survivors of work-related deaths;

(9) labor ability appraisal fee.

Article 39 The following expenses incurred due to work-related injuries shall be paid by the employing unit according to state regulations:

(1) wages and benefits during the treatment of work-related injuries;

(2) the monthly disability allowance for disabled employees with Grade V and VI;

(3) One-time disability employment subsidy that should be enjoyed when the labor contract is terminated or dissolved.

article 41 if an employee's employer fails to pay work-related injury insurance premiums according to law, and a work-related injury accident occurs, the employer shall pay work-related injury insurance benefits. If the employer does not pay, it shall pay in advance from the industrial injury insurance fund. The industrial injury insurance benefits paid in advance from the industrial injury insurance fund shall be repaid by the employer. If the employer fails to repay, the social insurance agency may recover the compensation in accordance with the provisions of Article 63 of this Law.
