Full text of the provisions of the Health Supervision Center of the Ministry of Health of all provinces, autonomous regions and municipalities directly under the Central Government:
In order to standardize the management of health food production enterprises, better implement the "Quality Management Standards for Health Food Production" (hereinafter referred to as GMP) and improve the management level of health food production, our department has formulated the "Review Methods and Evaluation Criteria for Quality Management Standards for Health Food Production", which are hereby printed and distributed to you. Please carefully organize the implementation. The relevant matters in the implementation are hereby notified as follows:
First, strengthen training. The health administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government shall train the health supervisors who participate in the evaluation, fully grasp the evaluation methods, evaluation criteria and related knowledge of the good production practices of health food, and unify the evaluation criteria. Those who fail the training shall not participate in GMP review.
Second, finish the review work on schedule. The health administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government shall complete the GMP examination of health food production enterprises within their respective jurisdictions before June 5438+February 3, 2003/kloc-0. After examination, the health food production enterprises that meet GMP are issued with health licenses. Health food production enterprises that basically meet the review results shall be ordered to make rectification within a time limit, and those that pass the rectification within 6 months shall be issued with health licenses; If the rectification is not carried out or the rectification is unqualified, the health permit shall not be issued. For health food production enterprises that fail to pass the inspection, their hygiene licenses shall be cancelled.
Three, strengthen the management of commissioned production of health food. Health food production enterprises that fail to meet GMP after examination by the provincial health administrative department may entrust enterprises that meet GMP to produce. The entrusted enterprise must hold a valid health food production license, and the product packaging label and instructions of the entrusted health food must be marked with "Entrusted XXXX Production" and the address of the entrusted production enterprise.
Fourth, seriously review discipline. Our department will conduct spot checks on health food production enterprises that have passed the examination in all provinces. Those who do not meet the GMP requirements and obtain the health food production license will be notified by our department, and the directly responsible person and the competent leader will be held accountable according to relevant regulations.
Before June 30, 2004, the health administrative departments of all provinces, autonomous regions and municipalities directly under the Central Government will report the overall situation of the review to our Ministry, and at the same time report the list of health food production enterprises that meet GMP and the corresponding product names. For the problems found in the implementation process, please contact our health legal system and supervision department in time.

Announcement on Adjusting the Approval Authority of Food Additive Production License (20 15)
In order to implement the Food Safety Law and the Measures for the Administration of Food Production License, according to the requirements of the reform of administrative examination and approval system and the principle of convenience and efficiency, the US Food and Drug Administration of Guangdong Province decided to adjust the examination and approval authority of local food and drug supervision departments (including Shunde District, the same below) for food additives production licenses.
Since February 1 2006, food and drug supervision departments at all levels are responsible for all the examination and approval links of the food additive production license within their respective administrative areas, such as application acceptance, on-site verification, examination and approval, certification, change, extension, replacement, correction, social announcement and information management, and the provincial food and drug administration will no longer undertake the examination and approval of the license.

Measures for the Administration of Health Food (1996)
Article 3 The health administrative department of the State Council (hereinafter referred to as the Ministry of Health) shall implement the examination and approval system for health food and health food instructions.

Article 6 The State Food and Drug Administration shall be responsible for supervising and guiding the administration of food production licenses throughout the country.
The local food and drug supervision and administration departments at or above the county level shall be responsible for the administration of food production licenses within their respective administrative areas.

Article 7 The food and drug supervision and administration departments of provinces, autonomous regions and municipalities directly under the Central Government may, according to food categories and food safety risks, determine the administrative authority of food production licenses of food and drug supervision and administration departments at the city and county levels.
The food and drug supervision and administration departments of provinces, autonomous regions and municipalities directly under the Central Government are responsible for the production licenses of health foods, formula foods for special medical purposes and infant formula foods.
Measures for the Administration of Health Food (1996)
Article 14 Before the production of health food, the food production enterprise must apply to the local provincial health administrative department, and only after the approval of the provincial health administrative department and the "×× health food" licensing item is marked on the applicant's health license can it produce.
Measures for the Administration of Food Production License (20 15)
Fifteenth engaged in food additive production activities, should obtain a food additive production license according to law.
To apply for a food additive production license, one should have a place, production equipment or facilities, food safety management personnel, professional and technical personnel and management system suitable for the variety of food additives produced.

Article 18 The production technology and conditions of health food must meet the corresponding hygiene standards of food production enterprises or other relevant hygiene requirements.
Measures for the Administration of Food Production License (20 15)
Article 32 During the period of validity of the food production license, if the layout of existing process equipment, process flow, main production equipment and facilities, food categories and other matters change, and it is necessary to change the licensing items specified in the food production license, the food producer shall submit an application for change to the food and drug supervision and administration department that originally issued the license within 10 working days after the change.
Where the production site moves out of the jurisdiction of the original food and drug supervision and administration department, it shall re-apply for a food production license.
If the items of the same food category and the address of the peripheral warehouse specified in the photocopy of the food production license change, the food producer shall report to the original food and drug supervision and administration department within 10 working days after the change.

Article 34 Where a food producer needs to extend the validity period of a legally obtained food production license, it shall apply to the food and drug supervision and administration department that originally issued the license within 30 working days after the expiration of the validity period of the food production license.

Article 39 The state practices a licensing system for the production of food additives. To engage in the production of food additives, it is necessary to have a place, production equipment or facilities, professional and technical personnel and management system suitable for the varieties of food additives produced, and obtain a food additive production license in accordance with the procedures specified in the second paragraph of Article 35 of this Law.
The production of food additives shall comply with food safety laws, regulations and national standards.
Measures for the Administration of Food Production License (20 15)
Article 41 Where a food producer terminates food production, withdraws or revokes a food production license or revokes a food production license, it shall apply to the food and drug supervision and administration department that originally issued the license for cancellation within 30 working days.
Where a food producer applies for cancellation of the food production license, it shall submit the following materials to the original food and drug supervision and administration department:
(1) An application for cancellation of the food production license;
(2) The original and duplicate of the food production license;
(3) Other materials related to the cancellation of the food production license.
