3. The food production license is an integral part of the industrial product license system. It is a monitoring system for food production and processing enterprises to ensure food quality and safety, which is formulated and implemented by the administrative department of quality supervision in the field of food production, aiming at controlling the production conditions of food production and processing enterprises. The food production license is divided into original and duplicate. The original and the copy have the same legal effect. The validity period of the food production and operation license is 5 years.
4. The food production license shall be issued by the food and drug supervision and administration department of the local people's government at or above the county level to the food production and business license institution according to law. Those who engage in food production and business activities without obtaining a food production and business license, or engage in food additive production activities without obtaining a food additive production license, the food and drug supervision and administration department of the people's government at or above the county level shall confiscate the illegal income and illegally produced and operated food, food additives and tools, equipment, raw materials and other items used for illegal production and business. If the value of food and food additives illegally produced and operated is less than 1 10,000 yuan, a fine of more than 50,000 yuan110,000 yuan will be imposed; If the value of goods is more than 1 10,000 yuan, a fine of more than 10 and less than 20 times shall be imposed.
Five, food production license issuing new rules:
1, the national certification of QS has been strengthened due to the continuous occurrence of food problems. In addition to the detailed regulations and accountability system for certification bodies and supervision and management, the requirements for enterprises in particular have been further improved.
2. Cancel the entrusted inspection, requiring enterprises to have the ability of ex-factory inspection. The enterprise that has obtained the certificate must set up its own laboratory before the end of the year, otherwise its QS certificate will be cancelled.
3.QS enterprises will accept strict post-certification supervision and inspection every year to review their application conditions. If serious disqualification is found, the QS certificate will be revoked. This work will be carried out by the provincial quality and technical supervision department.

Measures for the administration of food business license
Article 2 Anyone who engages in food sales and catering services within the territory of People's Republic of China (PRC) shall obtain a food business license according to law.
These Measures shall apply to the application, acceptance, examination, decision, supervision and inspection of food business license.
Article 10 An application for a food business license shall be made according to the business forms of food business entities and the classification of business items.
The main formats of food business are divided into food sales operators, catering service operators and unit canteens. Where a food business operator applies for operating through the network, setting up a central kitchen or delivering food collectively, it shall be indicated in brackets after the main business formats.
Food business projects are divided into prepackaged foods sales (including frozen food, excluding frozen food), bulk food sales (including frozen food, excluding frozen food), special food sales (health food, formula food for special medical purposes, infant formula milk powder, other infant formula food) and other food sales; Hot food, cold food, raw food, cakes, homemade drinks and other foods.
Specific varieties listed in other food sales and other food manufacturing and selling shall be reported to China Food and Drug Administration for approval before implementation, and clearly marked. Foods that are difficult to be clearly classified in hot, cold, raw, solid and liquid conditions can be classified according to the situation with the highest food safety risk level.
China Food and Drug Administration can adjust the categories of food business items according to the needs of supervision and management.
