1. This contract is a model text, which is applicable to the domestic team travel service relationship concluded between international and domestic travel agencies and tourists living in the administrative area of this Municipality.
Domestic package tour service refers to travel service activities such as transportation, catering, accommodation and sightseeing. Provided by travel agencies to cities or tourist attractions outside Hong Kong, Macao and Taiwan.
2. The model text consists of general terms and conditions for endorsement and special terms and conditions for contract. The "General Terms and Conditions" are the common provisions for the rights, obligations and responsibilities of both parties in domestic group tourism activities, while the "Special Terms and Conditions" are supplementary agreements made by both parties on special contents such as tourists' situation, tourism content arrangement and dispute settlement.
3. Before signing the contract, tourists should carefully read all the terms of this contract, especially Articles 2, 3, 5, 6 and 8 of the General Terms and Conditions and Article 3 of the Special Terms and Conditions. Please fill in the "Special Terms and Conditions" and indicate the "Contract Number" page by page; After completing the form, please keep the original and the travel agency keep the copy.
4. The "travel time" in Article 2 of the Special Terms and Conditions shall be based on the natural day (0: 00-24: 00), and the travel agency shall inform the tourists of the travel start time and other related matters before signing the contract.
5. Tourists should keep the relevant bills, vouchers and materials in tourism activities, so that they can be used as evidence of complaints and claims when their legitimate rights and interests are infringed. 6. This contract shall come into effect as of the date of signature and seal by both parties. Both parties may also modify or supplement the contract in writing. However, if the amendment or supplement contains contents that unreasonably reduce or exempt the responsibility of the travel agency as stipulated in the General Terms and Conditions, the General Terms and Conditions shall prevail. The travel schedule and travel instructions marked with the group number and departure date are all part of the contract.

General terms and conditions of domestic tourism contracts in Beijing
Article 1 the rights of tourists
(1) The right to choose your own travel agency. Tourists have the right to independently choose international and domestic travel agencies that operate domestic tourism business and accept the travel services provided by them.
(two) the right to know the real situation of travel agency services. Tourists have the right to ask the travel agency to provide the travel itinerary and travel instructions truthfully, and have the right to ask the travel agency to inform them of the real situation in accommodation, catering, transportation and service standards. (3) The right to require travel agencies to provide agreed services. Tourists have the right to ask the travel agency to arrange tours and coordinate related matters according to the contract and itinerary.
(four) the right to shop independently and fair trade. Tourists have the right to ask travel agencies to take groups to legal shopping places for voluntary shopping, and have the right to refuse shopping arrangements that violate the contract.
(five) the right to choose the project independently. Tourists have the right to refuse self-funded projects recommended by travel agencies that are not stipulated in the contract.
(6) the right to respect personal dignity and national customs.
(seven) the right to supervise the services of travel agencies. Tourists have the right to criticize and suggest acts of travel agencies that infringe upon their legitimate rights and interests, or to complain and report to relevant departments.
Article 2 obligations of tourists
(1) Comply with national and local laws and relevant regulations. Tourists are not allowed to engage in illegal activities during the tour.
(two) shall not infringe upon the rights and interests of others. When exercising their rights, tourists shall not harm the interests of the state, society or collective or the legitimate rights and interests of others.
(3) Abide by public order and respect social morality. Tourists should respect the personality of tourism service personnel and respect and help each other with team members; Respect local ethnic customs and habits; It is strictly forbidden to scribble on landscapes and buildings, and there are no uncivilized behaviors such as spitting and littering.
(four) truthfully submit the relevant materials and inform the relevant situation. Tourists should provide true health and identity information during registration and itinerary, fill in relevant information truthfully and perform legal procedures.
(five) abide by the contract and assist the travel agency to complete the travel service. Tourists should ensure their physical conditions to complete their tourism activities, and actively cooperate with the service activities of travel agencies. They should not force travel agencies to change the itinerary of travel teams or leave the group activities without authorization for personal reasons.
(six) efforts to master the knowledge needed for tourism, improve self-protection awareness. Tourists can choose to buy insurance such as personal accident insurance. They should take good care of their luggage and valuables and take other protective measures.
(seven) disputes with travel agencies in the course of travel should be settled through consultation on the principle of equality, or through the dispute settlement method agreed in the special terms after the trip. Do not refuse tourists to board the plane (car or boat) on the grounds of service quality, or take other measures to delay the trip, expand the impact and losses, and force the travel agency to accept its proposed conditions.
Article 3 The rights of travel agencies
(a) to verify the right of tourists to provide relevant information.
(2) the right to collect all the travel expenses from tourists according to the contract.
(3) the right to choose transportation, hotels, land agencies and arrange tourism supporting services according to the contract.
(4) Have the right to refuse unreasonable demands made by tourists beyond the scope of the contract.
Article 4 Obligations of travel agencies
(1) Show tourists the business license issued by the administrative department for industry and commerce and the travel agency business license issued by the tourism administrative department.
(two) in accordance with the provisions of the travel agency liability insurance, travel agency liability insurance.
(3) Providing conditions or methods for tourists to consult the relevant documents of the National Tourism Administration involved in this contract by informing the website and making a unified announcement.
(4) Provide tourists with travel itinerary and travel instructions before departure, truthfully explain the specific travel arrangements, various service standards and relevant matters needing attention, and shall not make false or misleading written or oral propaganda, and shall recommend personal accident insurance and other insurance to tourists.
(five) to provide tourism services to tourists in accordance with the contract, and shall not be lower than the standards stipulated in the "Quality Requirements for Domestic Tourism Services of Travel Agencies".
(six) the services provided meet the requirements of the personal and property safety of tourists. For tourist services that may endanger the personal and property safety of tourists, they should make a true explanation and clear warning to tourists, and take measures to prevent the occurrence of harm.
(seven) tourists shall not be forced to shop during the tour, and the arrangement of self-funded projects other than those agreed in the contract shall be subject to the consent of the tourists.
(eight) should provide invoices and other consumer vouchers to tourists.
Article 5 Travel expenses
(1) Travel expenses include the following expenses:
1. Fees for handling documents and formalities;
2. Transportation ticket fee: In case of fare adjustment, the refund of ticket fee shall be implemented according to Article 63 of the Contract Law;
3. Meal accommodation fee: including free meals provided by means of transportation such as flights;
4. Tour fee;
5. Travel service fee: including the service fee of the service personnel of the land agency and travel agency.
(2) Travel expenses do not include the following expenses:
1, travel expenses not stipulated in the contract;
2. Expenses related to self-funded projects;
3. Expenses during free activities;
