Waste edible oils and fats refer to inedible animal and vegetable oils and various oil-water mixtures. Article 3 These Regulations shall apply to the generation, collection, transportation, disposal and related management activities of kitchen waste in urban built-up areas within the administrative area of this Municipality.
The people's governments at or above the county level shall designate and announce the delivery, collection, transportation and disposal of kitchen waste in the areas where urbanization management is implemented, and may be implemented in accordance with the provisions of these regulations. Article 4 The people's governments of cities and counties (cities, districts) shall be responsible for leading, organizing and coordinating the management of kitchen waste within their respective administrative areas.
City and county (city, district) people's governments shall formulate policies conducive to the management and comprehensive utilization of kitchen waste, establish information sharing and law enforcement linkage mechanism, and improve the scientific level of kitchen waste management.
The Administrative Committee of Quzhou Green Industry Cluster Zone and the Administrative Committee of the West District of the city shall be responsible for the management of kitchen waste within their respective jurisdictions in accordance with the prescribed duties.
Township (town) people's governments and sub-district offices shall, in accordance with the provisions of the county (city, district) people's governments, be responsible for the management of kitchen waste within their respective jurisdictions. Article 5 The competent administrative department of environmental sanitation shall be responsible for the supervision and management of the transportation, collection, transportation and disposal of kitchen waste.
The comprehensive administrative law enforcement department is responsible for investigating and dealing with the illegal acts in the delivery, collection, transportation and disposal of kitchen waste, unless there are special provisions in this Ordinance.
The market supervision and management department is responsible for investigating and dealing with illegal acts of producing and processing food with kitchen waste as raw materials.
Environmental protection, public security, development and reform, finance, planning, information, health, agriculture, water conservancy, transportation, commerce, tourism, education, government affairs and other relevant departments shall, according to their respective functions and duties, do a good job in the management of kitchen waste. Article 6 The catering service industry association shall strengthen industry self-discipline, standardize industry behaviors, and popularize technologies and methods for reducing kitchen waste.
The news media shall publicize the laws, regulations and related knowledge of kitchen waste management for public welfare. Article 7 The competent administrative department of environmental sanitation shall, jointly with comprehensive administrative law enforcement, market supervision and management, environmental protection and other departments, improve relevant data and information, establish a comprehensive information platform for kitchen waste management, and announce the collection, transportation and disposal of kitchen waste to the public every quarter. Article 8 The competent administrative department of environmental sanitation shall establish a daily supervision and management system for kitchen waste, be responsible for the collection, transportation, disposal license, filing and business guidance of kitchen waste, and formulate assessment methods for kitchen waste collection, transportation and disposal units.
The competent administrative department of environmental sanitation shall formulate an emergency plan for the collection, transportation and disposal of kitchen waste and establish an emergency mechanism. Article 9 The competent administrative department of environmental sanitation shall, jointly with the local sub-district offices and township (town) people's governments, determine the location of kitchen waste collection containers in small catering concentrated areas. Article 10 When issuing a food business license, the market supervision and management department shall inform the kitchen waste generating unit to put the kitchen waste separately and hand it over to the collection and transportation unit for unified collection and transportation, and supervise it in daily supervision. Eleventh engaged in kitchen waste collection, transportation and disposal activities should have the corresponding conditions. The competent administrative department of environmental sanitation shall determine the collection, transportation and disposal units of kitchen waste through bidding and franchising. No unit or individual may engage in the collection, transportation and disposal of kitchen waste without authorization.
Whoever, in violation of the provisions of the preceding paragraph, engages in the collection, transportation and disposal of kitchen waste without authorization shall be ordered by the comprehensive administrative law enforcement department to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than three thousand yuan but not more than ten thousand yuan shall be imposed; If the circumstances are serious, a fine of not less than ten thousand yuan but not more than thirty thousand yuan shall be imposed. Twelfth kitchen waste generating units shall comply with the following provisions:
(1) Reduce the amount of kitchen waste by improving the processing technology;
(two) according to the standard to pay the garbage disposal fee;
(3) If kitchen waste is generated for the first time, inform the county (city, district) environmental sanitation administrative department of the type, quantity and generation time of kitchen waste ten days in advance; To terminate the generation of kitchen waste, inform the county (city, district) environmental sanitation administrative department five days in advance;
(four) according to the place, time and frequency agreed with the kitchen waste collection and transportation unit;
(five) put the kitchen waste into the special collection container provided by the collection and transportation unit, and keep it well sealed and the surrounding environment clean and tidy;
(six) the establishment of kitchen waste generation and destination record ledger;
(seven) other requirements stipulated by laws and regulations. Thirteenth kitchen waste generating units prohibit the following acts:
(a) kitchen waste is not stored in a sealed manner;
(2) Dumping, scattering or piling up kitchen waste at will;
(3) Entrusting units and individuals other than those specified in Article 11 of these Regulations to collect, transport and dispose of kitchen waste;
(4) Other prohibited acts as prescribed by laws and regulations.
In violation of the provisions of the first paragraph of this article, the kitchen waste is not stored hermetically, and the comprehensive administrative law enforcement department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than fifty yuan but not more than five hundred yuan shall be imposed.
Whoever, in violation of the provisions of the second paragraph of the first paragraph of this article, dumps, scatters or piles up kitchen waste at will shall be ordered by the comprehensive administrative law enforcement department to make corrections within a time limit and be fined not less than 5,000 yuan but not more than 50,000 yuan.
In violation of the provisions of the first paragraph of this article, the collection, transportation and disposal of kitchen waste by units and individuals other than those specified in Article 11 of this Ordinance shall be ordered by the comprehensive administrative law enforcement department to make corrections within a time limit; If no correction is made within the time limit, a fine of two thousand yuan or more and five thousand yuan or less shall be imposed; If the circumstances are serious, a fine of not less than 5,000 yuan but not more than 20,000 yuan shall be imposed.
