The Regulations of Chengdu Municipality on the Administration of City Appearance and Environmental Sanitation is divided into eight chapters and 53 articles, including general provisions, system of city appearance and environmental sanitation responsibility area, appearance management, environmental sanitation management, construction and management of environmental sanitation facilities, operation and service management of city appearance and environmental sanitation, supervision and management, and supplementary provisions, and will be implemented as of October 1, 2119.
Chapter I General Provisions
Article 1 In order to strengthen the management of city appearance and environmental sanitation, create a clean and beautiful working and living environment in the city, and promote the construction of socialist material civilization and spiritual civilization in the city, these Regulations are formulated in accordance with the Regulations of the State Council on the Management of City Appearance and Environmental Sanitation and the relevant laws and regulations of the state, combined with the actual situation of Chengdu.
article 2 all units and individuals within the city limits of this municipality must abide by these regulations.
article 3 the management of city appearance and environmental sanitation shall follow the principles of unified leadership, graded responsibility, combination of professional management and mass management, and combination of functional department supervision and social supervision.
Chengdu city appearance and environmental sanitation administration is the administrative department in charge of city appearance and environmental sanitation management, and is responsible for organizing the implementation of these regulations.
the competent department of city appearance and environmental sanitation of the district (city) county people's government is responsible for the management of city appearance and environmental sanitation within its jurisdiction.
street offices and town people's governments are responsible for the management of city appearance and environmental sanitation in their respective jurisdictions.
Public security, urban construction management, planning, environmental protection, health, industrial and commercial administration, public utilities, housing management, gardens, municipal engineering management, construction and other departments at all levels should perform their respective duties and closely cooperate with the competent department of city appearance and environmental sanitation to implement these regulations.
article 4 any unit or individual has the right to enjoy a clean and hygienic city appearance environment, discourage and accuse acts violating these regulations, and has the obligation to maintain city appearance and environmental sanitation facilities, respect the labor of city appearance and environmental sanitation workers and obey the supervision and management. Shall not obstruct or hinder the city appearance and environmental sanitation staff from performing their official duties and the normal operation of the workers.
article 5 newspapers, radio, television, publishing, culture, education and other departments, as well as business and management units of public places, should strengthen publicity and education on city appearance and environmental sanitation, and all kinds of schools should arrange education activities on city appearance and environmental sanitation, enhance citizens' awareness and moral level of city appearance and environmental sanitation, and consciously abide by city appearance and environmental sanitation laws and regulations.
article 6 the people's governments of cities and counties (cities) shall incorporate the cause of city appearance and urban environmental sanitation into the national economic and social development plan and the overall urban planning of their respective regions and organize their implementation.
article 7 the collection, removal and treatment of urban wastes, garbage and excrement shall be subject to the service charge system.
chapter ii city appearance management
article 8 all kinds of buildings and public facilities facing the street in a city must be well protected and clean, and the newly built buildings and public facilities should meet the city appearance standards stipulated by the state.
Article 9 Without approval, no unit or individual is allowed to open a shop, set up a shed or rebuild a balcony, or hang or pile up objects that are harmful to the cityscape on the balcony or outside the window. The flowerpots should be arranged safely and beautifully.
article 11 without the approval of the municipal people's government or the relevant competent department authorized by the municipal people's government, no unit or individual is allowed to occupy urban roads to set up bazaars, set up stalls, stack materials and build temporary buildings. approved units and individuals occupying roads should operate or operate within the approved scope of the site, and be responsible for the city appearance and environmental sanitation management of the lot, and pay the occupation fee according to the regulations.
Shops along the street are not allowed to cross the street and occupy the road.
It is not allowed to spread articles, pile up and dump garbage and wastes on urban roads.
it is not allowed to set up mourning halls and hang memorial banners on both sides of urban roads.
loading and unloading articles on urban roads should be carried out within the specified time. If it is really necessary to temporarily load and unload small articles, it is not allowed to pollute the road and block traffic during loading and unloading.
article 11 outdoor billboards (columns), sculptures, galleries, signboards, placards, windows, etc. that have been approved for installation must have healthy contents, complete pictures, standardized words and beautiful appearance. Release or set up units should ensure safety, regular maintenance, keep clean and tidy, and shall not affect the city landscape.
the establishment of large-scale outdoor advertisements must obtain the consent of the municipal administration of city appearance and environmental sanitation, and go through the examination and approval procedures in accordance with relevant regulations.
Article 12 The municipal administration, public security, public utilities, housing management, power supply, communication, fire protection, culture, sports, commerce and other departments of the city shall be responsible for maintaining and keeping the required street facilities in good condition and cleanliness.
Thirteenth urban landscaping departments and relevant units should always keep the landscaping facilities clean and beautiful. Leaves and dregs left over from the renovation of street trees in green streets should be removed in time to keep the green spaces and streets clean and tidy.
article 14 the construction unit must set up obvious signs and safety protection facilities such as guardrails and baffles on the construction site. Stacked materials and machines must be neat, and construction waste residue must be removed in time, so as not to interfere with traffic and pedestrian activities.
Article 15 Motor vehicles and non-motor vehicles must be parked in the parking lot or the place where parking is allowed. It is not allowed to park in the driveway, sidewalk and other places that hinder traffic.
Article 16 Any vehicle with untidy vehicle appearance must be cleaned. All kinds of vehicles driving in the city must keep the vehicle clean and tidy, and are not allowed to throw waste outside the vehicle. Vehicles carrying bulk objects and liquid goods such as building materials, waste soil and waste residue and domestic garbage should be firmly tied and sealed tightly, and are not allowed to scatter, fly and leak along the street.
Chapter III Cleaning and Cleaning Management
Article 17 The cleaning and cleaning of urban streets shall be the responsibility of the environmental sanitation management department. The cleaning and cleaning of green belts, small parks and green spaces shall be the responsibility of the garden management department and the environmental sanitation responsibility area respectively.
article 18 all units are responsible for the cleaning of airports, railway stations, bus (electric) terminals, parks, various parking lots and other public places.
Article 19 Approved stalls, kiosks and mobile trucks must keep their sales sites clean and tidy, and remove their own wastes; The occupation unit shall be responsible for the cleaning and cleaning of roads and public * * * venues that have been approved for occupation; The market management department is responsible for the cleaning and cleaning of the bazaars.
Article 21 The environmental sanitation within the resident scope of state organs, public organizations, military units, enterprises and institutions shall be removed by themselves or entrusted by the sanitation department. On both sides of the city streets, the responsibility system of "three guarantees in front of the door" is implemented (including sanitation, greening and order in front of the door).
Article 21 All units and individuals must strictly abide by the following provisions:
(1) No spitting;
(2) it is forbidden to throw away the peels, stones, scraps of paper, cigarette butts, glass bottles (residues), packaging and other wastes;
(3) It is forbidden to urinate anywhere or dump garbage and feces into the sewer;
(4) it is forbidden to dump sewage, garbage, waste or abandon animal carcasses on the street;
(5) It is forbidden to scribble, carve, paste, nail or hang on street buildings, structures, public facilities and street trees;
(6) it is forbidden for motor vehicles with untidy vehicles to drive into or in urban areas;
(7) It is forbidden to repair cars and wash cars on urban roads without a license;
(8) it is forbidden to throw paper flowers and paper in the funeral;
(9) It is forbidden to throw wastes or dump garbage and construction waste residues into green belts, small gardens and green spaces;
(11) It is forbidden for residents to raise edible livestock and open poultry in urban areas;
(11) It is forbidden to keep dogs in urban areas (except guard dogs, military dogs, scientific research dogs, performing dogs and ornamental dogs), and the management of ornamental dogs should be strict.
chapter iv removal and disposal of wastes
article 22 municipal solid waste must be dumped into garbage platforms, containers, garbage trucks or designated places according to regulations.
the wastes, charcoal ashes and construction wastes generated by the production and operation of units and individual operators should be removed to the place designated by the environmental sanitation management department or entrusted by the environmental sanitation operation unit, and they are not allowed to be dumped into the garbage bin (platform).
article 23 medical units, scientific research units, biological products factories, slaughterhouses and other special solid wastes with viruses and germs, animal carcasses, abandoned radioactive substances, etc., are not allowed to be mixed with domestic garbage, and are not allowed to enter domestic garbage dumps. Special solid wastes and animal carcasses are collected, removed and treated harmlessly by the municipal environmental sanitation management department; Waste radioactive materials shall be disposed of in accordance with relevant state regulations.
article 24 the municipal solid waste and excrement shall be uniformly managed and removed by the environmental sanitation administrative department. The environmental sanitation management department must make garbage daily and daily, and shall not overstock; The feces shall be removed in time, and the pit shall not overflow.
Chapter V Management of Public Sanitation Facilities
Article 25 The construction of public sanitation facilities such as public toilets, garbage dumps (stations), manure storage stations (pools) and garbage collection stations (barrels) must be incorporated into the urban construction plan, with unified layout, and be designed, constructed and used simultaneously with the construction of new areas and the transformation of old cities.
article 26 any unit building, expanding or rebuilding a building must set up environmental sanitation facilities according to regulations.
no unit or individual may obstruct or hinder the construction, expansion and reconstruction of various environmental sanitation facilities.
article 27 all units and individuals must take good care of public environmental sanitation facilities, and are not allowed to destroy, move or dismantle them. if it is really necessary to demolish them due to construction, the construction unit must report to the competent department of city appearance and environmental sanitation for approval, and then demolish them according to the principle of building first.
article 28 environmental sanitation management departments at all levels should strengthen the maintenance and management of public environmental sanitation facilities and keep them in good condition and cleanliness.
Public toilets, garbage dumps (stations), manure stations and manure transport points must be managed by special personnel, and disinfected regularly to prevent mosquitoes and flies from breeding.
article 29. without approval, no unit or individual is allowed to rent or rent cultivated land to pile up garbage without authorization.
Chapter VI Awards and Penalties
Article 31 Units and individuals that have made remarkable achievements or made great contributions in the work of city appearance and environmental sanitation shall be commended or rewarded by the people's governments at all levels or the administrative departments of city appearance and environmental sanitation.
article 31 in case of any of the following acts in violation of the provisions of these regulations, the administrative department of city appearance and environmental sanitation or other supervisory and administrative departments may, in addition to criticizing and educating and ordering rectification, order them to make restitution, compensate for losses, carry out renovation within a time limit, dismantle them within a time limit, impose a fine, suspend business for rectification, and confiscate the tools, articles and illegal income engaged in illegal activities according to different circumstances; Those who have not been renovated or demolished within the time limit may be forcibly renovated or demolished according to law:
(1) spitting, urinating, littering fruits and skins, cores, scraps of paper, paper flowers, paper, cigarette butts, glass bottles (residues), packaging, littering animal carcasses, and dumping sewage, waste, garbage and feces;
(2) scribbling, scribbling, scribbling, pasting, nailing or hanging on buildings, structures or public facilities facing the street;
(3) occupying the road to build sheds, pile things up, repair cars, wash cars, pile things in the sun, set up stalls or go out of the door to occupy the road to operate, occupy the road to set up mourning halls to hang sacrifices;
(4) leaking, scattering wastes, garbage, feces, etc. during loading and unloading and transportation, which pollutes the environment;
(5) Failing to remove garbage and feces in time according to regulations, resulting in the breeding of mosquitoes and flies and the overflow of feces;
(6) garbage and toxic harmful waste generated by industrial production, construction and commercial operation are not removed, dumped or piled up according to regulations;
(7) failing to set up or remove environmental sanitation facilities in accordance with regulations, thus damaging the environmental sanitation facilities;
(8) Failing to set up billboards (columns), sculptures, galleries, signboards, signs, slogans and windows as required;
(9) Environmental sanitation facilities fail to take anti-pollution measures such as cleaning and disinfection as required;
(11) failing to eliminate the four pests (rats, flies, mosquitoes and cockroaches) according to the unified regulations;
(11) the construction site affects traffic safety and hinders the removal of garbage and feces;
(12) refusing to implement the environmental sanitation responsibility area system;
(13) blocking sewers and manure pools, causing environmental pollution;
(14) Street shops do not implement the "three guarantees in front of the door", which seriously affects the city appearance and environmental sanitation and refuses to make corrections within a time limit;
(15) renting or renting cultivated land without authorization to pile up garbage and pollute the environment;
(16) changing the nature of the use of houses facing the street without authorization, affecting the city appearance and environmental sanitation or obstructing traffic;
(seventeen) other acts in violation of the provisions of these regulations.
Article 32 Anyone who violates the provisions of these Regulations and commits any of the following acts shall be criticized and educated by the administrative department of city appearance and environmental sanitation or the unit entrusted by it, ordered to make corrections and take remedial measures, and may be fined, detained or confiscated tools and articles engaged in illegal activities, ordered to suspend business for rectification, confiscated illegal income and revoked the business license of occupying the road:
(1) Renting or transferring the booth of occupying the road;
(2) leasing or transferring the business license for occupying roads;
(3) setting up a stall without a business license for occupying roads;
(4) changing the nature of occupying roads without authorization;
(5) raising dogs without authorization;
(6) keeping livestock and poultry in urban areas;
(7) default or refusal to pay the occupation fee.
article 33 whoever violates these regulations and disobeys education management and beats law enforcement personnel and city appearance and environmental sanitation workers shall be punished by the public security organs in accordance with the regulations of the people's Republic of China on administrative penalties for public security, and if the case constitutes a crime, the judicial organs shall investigate the criminal responsibility according to law.
article 34 if a unit or individual refuses to accept the punishment decision, it may apply for reconsideration to the superior competent authority of the department that made the punishment decision within 15 days from the date of receiving the punishment decision; If you are dissatisfied with the reconsideration decision, you can bring a suit in a people's court within 15 days from the date of receiving the reconsideration decision, or you can bring a suit directly in a people's court. If it fails to apply for reconsideration or bring a lawsuit or perform the punishment decision within the time limit, the department that made the punishment decision shall apply to the people's court for compulsory execution.
article 35 units and individuals that violate the provisions of these regulations and cause pollution to the city appearance and environmental sanitation have the responsibility to remove the pollution, eliminate the hazards, and compensate the units or individuals that directly suffer from the pollution hazards.
disputes over the liability for compensation and the amount of compensation can be handled by the competent department of city appearance and environmental sanitation at the request of the parties. If the parties are not satisfied with the handling, they can be handled in accordance with the provisions of relevant laws and regulations.
article 36 all kinds of buildings, structures and public facilities facing the street that do not meet the standards of city appearance and environmental sanitation stipulated by the state shall be ordered by the administrative department of city appearance and environmental sanitation of the people's government of the city in conjunction with the administrative department of city planning to transform or dismantle them within a time limit; If it has not been rebuilt or demolished within the time limit, it shall be forcibly demolished by the city appearance and environmental sanitation administrative department or the city planning administrative department with the approval of the people's government at or above the county level, and may also be fined.
Article 37 Whoever steals or destroys various municipal and environmental sanitation facilities shall be punished by the public security organ in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.
article 38 if an operator of city appearance and environmental sanitation causes pollution of city appearance and environmental sanitation due to dereliction of duty, the unit to which he belongs or the competent department at a higher level shall give him criticism or administrative sanctions according to the circumstances.
