Provisions of Shenzhen Municipality on the Supervision and Administration of Bean Products

article 1 these provisions are formulated in accordance with the provisions of the food hygiene law of the people's Republic of China, the product quality law of the people's Republic of China and other laws and regulations, combined with the actual situation of this municipality, in order to standardize the production and operation order of bean products in our city, strengthen the supervision and management of bean products, and ensure people's health and safety. Article 2 The production, processing, sales, supervision and management activities of bean products within the administrative area of this Municipality shall abide by these provisions. Article 3 The term "bean products" as mentioned in these Provisions refers to non-fermented bean products made from soybeans without fermentation, including tofu, soybean milk, dried bean curd, oily bean curd, dried bean curd, yuban, bean curd, etc.

The term "ready-made bean products" as mentioned in these Provisions refers to the bean products that are directly consumed by consumers after being processed on the spot by catering operators in their business premises.

the technical specifications mentioned in these provisions refer to the technical specifications for bean products promulgated and implemented with the approval of the municipal government.

the "controlled operation area" as mentioned in these provisions refers to the operation area where people flow, logistics, invasion of harmful substances, etc. must be strictly controlled in the production process. The controlled operation area includes clean operation area and quasi-clean operation area.

the catering industry mentioned in these provisions refers to the food production and operation industries that provide consumers with food, places and facilities for consumption by means of instant processing, commercial sales and service labor, including restaurants, snack bars and fast food restaurants, except canteens. Article 4 The people's governments of all districts shall take overall responsibility for the safety of bean products within their respective jurisdictions, and uniformly lead, organize and coordinate the supervision of bean products.

the quality supervision department is responsible for the hygiene license and daily supervision of the production and processing of bean products.

the industrial and commercial department is responsible for the daily supervision of the circulation of bean products.

the health department is responsible for the daily supervision of the health licensing and consumption of bean products in circulation.

Urban comprehensive administrative law enforcement, environmental protection, trade and industry departments are responsible for relevant supervision work in accordance with relevant laws and regulations and responsibilities determined by the municipal government. Article 5 A bean product producer or operator shall first obtain a hygiene license according to law before applying for registration with the industrial and commercial department. The catalogue of bean products subject to the delivery note system and specific management measures shall be formulated separately by the municipal industrial and commercial department. Article 8 The production, operation and distribution enterprises of soybean milk, bean curd and other bean products that need to be stored and transported at low temperature shall be equipped with corresponding cold storage, freezers and other facilities, and closed special refrigerated vehicles shall be used for transportation.

the refrigeration temperature in production should be 1℃ ~ 4℃, and the refrigeration temperature in circulation, consumption and transportation should be below 11℃.

if laws, regulations, relevant standards or technical specifications clearly stipulate the refrigeration temperature and equipment of bean products, those provisions shall prevail.

the catalogue of bean products stored and transported at low temperature shall be published separately by the municipal quality supervision department. Article 9 The use area of the controlled operation area of bean product production and processing enterprises shall not be less than 511 square meters. Article 11 Bean products shall be pre-packaged, and the packaging materials shall comply with the relevant provisions of the state.

pre-packaged bean products should have labels. The label shall comply with the relevant regulations and indicate the date of production. Eleventh bean products production and processing enterprises should set up quality inspection institutions, equipped with necessary testing instruments, equipment and personnel.

Twelfth bean products production and processing enterprises should establish a ledger, indicating the procurement of raw and auxiliary materials and product production, sales and other related information. Thirteenth bean products operators should establish a system of inspection and acceptance of incoming goods, check the quality and hygiene of bean products, and check the qualification certificate, delivery note and label identification of bean products.

bean product operators shall establish purchase and sale ledgers, which shall specify varieties, specifications, batch numbers, production units, quantities and dates. The on-site processing and production of bean products in the catering industry shall comply with the following regulations, meet the requirements of environmental protection, and obtain the hygiene license:

(2) If bean products need to be refrigerated and kept warm according to regulations, corresponding facilities shall be provided;

(4) establish records of production, requisition and batch sales. Article 15 When conducting supervision and inspection of bean products according to their respective responsibilities, the relevant regulatory authorities may exercise the following functions and powers according to law:

(1) conducting on-site inspection of places where bean products are produced, sold and used;

(2) Investigate and understand the relevant situation, consult and copy relevant records and materials;

(3) sealing up production and business premises, and sealing up or detaining equipment, raw materials and products;

(4) check or spot check the quality of bean products;

(5) other functions and powers as stipulated by laws, regulations and rules.

The regulatory authorities can deal with the sealed and detained bean products first after taking other evidence preservation measures.
