Article 1 This Law is formulated for the purpose of strengthening the management of urban and rural planning, coordinating the spatial layout of urban and rural areas, improving the living environment and promoting the comprehensive, coordinated and sustainable development of urban and rural economy and society.

Article 2 This Law must be observed in the formulation and implementation of urban and rural planning and in the construction activities within the planned area.

Urban and rural planning as mentioned in this Law includes urban system planning, urban planning, town planning, township planning and village planning. Urban planning and town planning are divided into overall planning and detailed planning. Detailed planning is divided into control detailed planning and construction detailed planning.

The planning area mentioned in this Law refers to the built-up areas of cities, towns and villages, and the areas that must be controlled by planning for the needs of urban and rural construction and development. The specific scope of the planning area shall be defined by the relevant people's government in the overall urban planning, town planning, township planning and village planning according to the level of urban and rural economic and social development and the needs of urban and rural overall development.

Article 3 Cities and towns shall formulate city plans and town plans in accordance with this Law. Construction activities within a planned urban area shall conform to the planning requirements.

The local people's governments at or above the county level shall, according to the local rural economic and social development level and the principle of adapting measures to local conditions and being practical, determine the areas where township planning and village planning should be formulated. Townships and villages in designated areas shall make plans in accordance with this law, and the construction of townships and villages in the planned areas shall meet the planning requirements.

Local people's governments at or above the county level shall encourage and guide townships and villages in areas other than those specified in the preceding paragraph to formulate and implement township plans and village plans.

Article 4 The formulation and implementation of urban and rural planning shall follow the principles of urban and rural planning as a whole, rational layout, land conservation, intensive development and planning before construction, improve the ecological environment, promote the conservation and comprehensive utilization of resources and energy, protect natural resources such as cultivated land and historical and cultural heritage, maintain local characteristics, national characteristics and traditional features, and prevent pollution and other public hazards, so as to meet the requirements of regional population development, national defense construction, disaster prevention and mitigation, public health and public health.

Construction activities in the planning area shall comply with the provisions of laws and regulations on land management, natural resources and environmental protection.

The local people's governments at or above the county level shall, according to the reality of local economic and social development, reasonably determine the development scale, steps and construction standards of cities and towns in the overall urban planning and town planning.

Article 5 The compilation of overall urban planning, town planning, township planning and village planning shall be based on the national economic and social development planning and be linked with the overall land use planning.

Article 6 People's governments at all levels shall include the funds for the preparation and management of urban and rural planning into the fiscal budget at the corresponding level.

Seventh urban and rural planning approved according to law is the basis of urban and rural construction and planning management, and may not be amended without legal procedures.

Eighth urban and rural planning organizations shall promptly publish the urban and rural planning approved according to law. However, the contents prohibited by laws and administrative regulations are excluded.

Article 9 All units and individuals shall abide by the urban and rural planning approved and published according to law, obey the planning management, and have the right to inquire the competent department of urban and rural planning whether the construction activities involving their interests meet the planning requirements.

Any unit or individual has the right to report or accuse violations of urban and rural planning to the competent department of urban and rural planning or other relevant departments. The competent department of urban and rural planning or other relevant departments shall promptly accept reports or complaints and organize verification and handling.

Article 10 The State encourages the adoption of advanced science and technology to enhance the scientificity of urban and rural planning and improve the effectiveness of its implementation, supervision and management.

The competent department of urban and rural planning of the local people's governments at or above the county level shall be responsible for the management of urban and rural planning within their respective administrative areas.
