Violation of the provisions of Article 33 (1), (3), (4) of these Regulations, the comprehensive law enforcement department of urban management shall order rectification within a certain period of time; if it fails to do so, it shall be subject to a fine of not less than 1000 yuan and not more than 10,000 yuan.
Violation of the provisions of Article 33 (5) of these Regulations, the classification of household garbage management responsibility for household garbage to unauthorized or record enterprises and individuals to dispose of household garbage, by the comprehensive law enforcement department of urban management shall order a period of time to make corrections, and impose a fine of 5,000 yuan or more than 50,000 yuan or less. Violation of the provisions of the first paragraph of Article 34 of these regulations, the person responsible for the management of domestic waste classification has not been registered for the discharge of domestic waste or registration of false information, by the comprehensive law enforcement department of urban management ordered to make corrections within a certain period of time; overdue corrections can be imposed a fine of 1,000 yuan.
In violation of the provisions of the second paragraph of Article 34 of these Regulations, the person responsible for the management of classification of household garbage has not established a household garbage management account, or does not truthfully record the discharge of household garbage within the scope of responsibility, the comprehensive law enforcement department of urban management shall order rectification, and shall impose a fine of 1000 yuan or more than 10,000 yuan or less. Violation of the provisions of article 40 (a) of these regulations, by the urban management and law enforcement departments ordered to make corrections, and impose a fine of 500 yuan or more than 3,000 yuan; the circumstances are serious, by the original licensing authority to revoke the collection of domestic garbage, transportation business license.
Violation of the provisions of Article 40 (2) of these Regulations, the comprehensive urban management and law enforcement departments shall order the removal, and impose a fine of 5,000 yuan or more than 50,000 yuan or less; the circumstances are serious, by the original licensing authority to revoke the domestic garbage collection, transportation business license.
Violation of the provisions of Article 40 (3) of these Regulations, the comprehensive urban management and law enforcement departments ordered to make corrections within a certain period of time, and impose a fine of not less than 1,000 yuan and not more than 10,000 yuan; the circumstances are serious, by the original licensing authority to revoke the life of the garbage collection, transportation business license. Catering service units in violation of the provisions of Article 43, paragraph 2 of the Ordinance collection, treatment of kitchen waste, by the comprehensive urban management law enforcement departments ordered to suspend business rectification, and may impose a fine of 5,000 yuan or more than 50,000 yuan or less.
Violation of the provisions of Article 43, paragraph 3 of these Regulations, the use of food waste without harmless treatment of livestock and poultry, or the production, sale and use of food waste cooking oil as raw materials, by the agriculture, quality and technical supervision, industry and commerce administration, health and other administrative departments in accordance with their respective responsibilities shall be investigated and dealt with; constitutes a crime, shall be investigated for criminal responsibility.
Unqualified units and individuals in violation of the provisions of Article 43, paragraph 3 of these Regulations to collect and transport kitchen waste, by the urban management and law enforcement departments to suspend their vehicles, confiscate the illegal collection and transportation of kitchen waste, and may impose a fine of 5,000 yuan or more than 50,000 yuan. Violation of road traffic safety laws and regulations on road access to the vehicle on the road, by the public security organs of the traffic management department shall be investigated and dealt with according to law. Violation of the provisions of Article 47 (a), (b), by the urban management and law enforcement departments shall order rectification within a specified period of time, and may impose a fine of 30,000 yuan or more than 100,000 yuan; the circumstances are serious, by the original licensing authority to revoke the life of the garbage disposal business license; due to the emission does not meet the standard, to the unit and individual losses caused by the compensation shall be made in accordance with the law.
In violation of the provisions of Article 47 (3) and (4) of these Regulations, failure to carry out testing in accordance with the requirements of the comprehensive law enforcement department of urban management shall be ordered by the department to make corrections within a specified period of time and may be fined not less than 30,000 yuan and not more than 100,000 yuan; failure to transmit the data to the municipal and cityscape administrative department of the operation of domestic waste disposal facilities to supervise and manage the information system, shall be ordered by the department of urban management to make corrections within a specified period of time and may be fined not less than 2,000 yuan. Correction, and may impose a fine of not less than 2000 yuan and not more than 20,000 yuan.
Violation of the provisions of Article 47 (5) of these Regulations, the comprehensive urban management and law enforcement departments shall order rectification within a certain period of time and impose a fine of not less than RMB 1,000 yuan and not more than RMB 10,000 yuan; if the circumstances are serious, the original licensing authority shall revoke the license for the operation of domestic garbage disposal.
In violation of the provisions of Article 47 (6) and (7) of these Regulations, the operation and management unit of the centralized transfer of domestic waste, treatment facilities are not in accordance with the requirements of the public facilities pollution control monitoring indicators and treatment facilities operation data or open the facilities to the public, by the comprehensive law enforcement department of the urban management ordered to make corrections within a certain period of time; if no correction is made after the deadline, a fine of 30,000 yuan. The meaning of the relevant terms in this regulation:
(a) construction projects supporting the classification of living garbage facilities, including garbage sorting station (room), garbage sorting collection room, closed garbage sorting cleaning station and other facilities and equipment.
(2) Recyclables, which are generated in daily life or activities providing services for daily life, have lost all or part of their original value of use, and can become raw materials for production after recycling or can be reused after sorting, mainly including waste paper, plastics, glass, metals, e-waste, fabrics and so on.
(C) construction waste, refers to construction units, construction units of new buildings, alterations, expansion, demolition of various types of buildings, structures and urban roads, highway construction, etc., as well as residents in the process of decorating the house of the discarded soil, discarded materials, and other wastes, as the management of domestic waste.
(4) Kitchen waste refers to food scraps, food processing waste and waste edible oil and grease produced by enterprises engaged in catering operations and collective canteens of institutions, troops, schools, enterprises and institutions in the course of food processing, catering services, unit feeding and other activities. Among them, waste edible oil and grease refers to non-reusable animal and plant fats and oil-water mixtures.
(v) Food waste refers to perishable waste such as vegetable helpers and leaves, melon and fruit peels and cores, leftovers and discarded food generated in households.
(F) food service units, refers to enterprises engaged in food service operations and collective canteens of institutions, troops, schools, enterprises and institutions.
(vii) Professional service units for the collection and transportation of domestic garbage, including enterprises that have obtained permits to engage in the operational collection and transportation of domestic garbage and institutions that undertake environmental sanitation operations. This regulation shall come into force on March 1, 2012 onwards.
