In order to strengthen the planning, construction and management of parking lots (garages) in this Municipality, regulate the relationship between parking supply and demand, improve traffic conditions, and protect the legitimate rights and interests of parking lot (garages) operators and parking people, these measures are formulated in accordance with the provisions of the Regulations of Shanghai Municipality on Road Transportation Management and other relevant laws and regulations. Article 2 (Scope of Application)
These Measures shall apply to the planning, construction, use and related management activities of parking lots (garages) within the administrative area of this Municipality.
Parking lots (garages) as mentioned in these Measures include public parking lots (garages), road parking lots and special parking lots (garages). Article 3 (Administrative Department)
The municipal traffic administrative department is the competent department of the parking lot (garage) in this Municipality, responsible for organizing the implementation of these measures and supervising and managing the parking lot (garage) in this Municipality.
The district traffic administrative department shall be responsible for the supervision and management of parking lots (garages) within its jurisdiction in accordance with the prescribed duties.
The administrative departments of planning resources, construction, public security, transportation, housing management, finance, price, market supervision, taxation, fire protection, greening and city appearance of this Municipality shall, according to their respective functions and duties, coordinate the implementation of these measures. Article 4 (Trade Associations)
The parking service industry association of this Municipality shall, in accordance with the relevant provisions, formulate industry self-discipline norms, carry out industry service quality evaluation and training, and assist the relevant administrative departments in the management of parking lots (garages). Article 5 (Encouragement and Promotion)
This Municipality encourages social funds to invest in the construction of public parking lots (garages), encourages the comprehensive utilization of underground spaces and other public parking lots (garages), and promotes the application of intelligent and informational means to manage parking lots (garages). Chapter II Planning and Construction Management of Parking Lot Article 6 (Planning)
* * * Parking lot (garage) special planning shall be compiled by the municipal traffic administrative department according to the city's comprehensive traffic planning and traffic demand, jointly with the municipal planning resources and construction administrative department, and incorporated into the corresponding urban and rural planning after being approved by the municipal government. The parking lot (garage) determined by the special planning of public parking lot (garage) belongs to the land of road square, and its use shall not be changed without legal procedure adjustment. Article 8 (Formulation of Standards and Design Specifications)
The design scheme of public parking lots (garages) and special parking lots (garages) shall conform to the setting standards and design specifications of national and municipal parking lots (garages).
The standards and design specifications of parking lots (garages) in this Municipality shall be compiled by the municipal traffic administrative department in conjunction with the municipal public security traffic and planning resources administrative department, and implemented after being approved by the municipal construction administrative department. Article 9 (Supporting Construction)
New public parking lots (garages) shall be constructed in accordance with the national and municipal parking lots (garages) (including public parking lots (garages) and special parking lots (garages)).
The newly-built public transport hub should be based on the comprehensive passenger transport hub planning of this Municipality, and the public transport interchange parking lot (garage) should be built.
Supporting the construction of the parking lot (garage) should be synchronized with the main project design, synchronous construction, synchronous acceptance, synchronous delivery. Article 10 (Supplementary Construction)
The following public buildings are not built in accordance with the national and municipal parking lot (garage) setting standards and design specifications, and shall be rebuilt and expanded:
(a) airports, railway stations, port passenger stations, inter-provincial road passenger stations, public transport and self-use motor vehicles hub stations;
(2) stadiums, theaters, libraries, hospitals, exhibition venues, tourist attractions, commercial office buildings and offices that undertake administrative affairs with foreign countries;
(three) shopping malls, hotels, restaurants, entertainment and other business places with a construction area of more than 5000 square meters.
If the public * * building specified in the preceding paragraph is unable to build a parking lot (garage) due to objective environmental conditions, the owner of the public * * building shall submit the relevant expert technical demonstration report to the municipal and district planning and resource administrative departments. Article 11 (Construction Review)
The relevant departments of this Municipality shall review the construction of public parking lots (garages) and special parking lots (garages) in accordance with the relevant provisions of the state and the examination and approval of construction projects in this Municipality.
The municipal and district planning and resource administrative departments shall solicit the opinions of the municipal and district traffic administrative departments when reviewing the design scheme of construction projects. Article 12 (Completion Acceptance)
The municipal and district construction administrative departments shall organize the municipal and district traffic administrative departments to do a good job in the completion and acceptance of the parking lot (garage) when carrying out the completion and acceptance of the construction project. Article 13 (Audit of Changing the Nature of Use)
No unit or individual may arbitrarily use the built public parking lot (garage) or special parking lot (garage) for other purposes.
To change the nature of the use of public parking lots (garages) or special parking lots (garages), it shall be approved by the municipal and district planning and resource administrative departments in conjunction with the municipal and district traffic administrative departments and the public security traffic administrative departments. Chapter III Operation and Management of Public Parking Lot (Garage) Article 14 (Industrial and Commercial Registration for the Record)
Operators of public parking lots (garages) shall go through the formalities of industrial and commercial registration and tax registration according to law, and go through the filing formalities with the traffic administrative department or the road transport management institution stipulated in the Regulations of Shanghai Municipality on Road Transport Management within 15 days after industrial and commercial registration.
Operators of public parking lots (garages) who change the registered items or close down shall go through the relevant formalities with the market supervision and tax authorities in accordance with regulations, and go through the filing formalities with the original filing department within 15 days from the date of change or closure. If the public parking lot (garage) is closed, the operator shall announce it to the public 5 days in advance.
