Apply for a gas business license, should have the following conditions:
(a) in line with the gas development planning requirements.
Gas business area, gas type, supply mode and scale, gas facilities layout and construction schedule in line with the gas development plan approved by law.
(B) there are gas sources that meet national standards.
Sign a gas supply contract with the gas source production and supply enterprises; the gas source should be in line with the national town gas gas quality standards.
(C) there are gas facilities in line with national standards.
There are gas production, storage, transmission and distribution, supply, metering, safety and other facilities and equipment in line with national standards; gas facilities construction in line with legal procedures, completion and acceptance and record in accordance with the law.
(D) have a fixed place of business.
There are fixed office space, business and service sites.
(E) have a sound safety management system and sound business program.
Safety management system mainly includes: production safety responsibility system, facilities and equipment (including user facilities) safety inspection, testing system, gas quality testing system, job operating procedures, gas emergency response plan, gas safety publicity system.
Operation program mainly includes: business charter, development planning, engineering construction plans, user development business processes, fault repair, complaint handling, quality assurance and safety of gas service system.
(F) the main person in charge of the enterprise, safety management personnel, as well as operation, maintenance and repair personnel by professional training and qualified by the gas management department. Professional training and assessment of specific measures to be formulated separately.

Legal Basis
Measures for the Administration of Gas Operation License (2019 Amendments)
Article 1 In order to regulate the behavior of gas operation license, strengthen the management of gas operation license, according to the "Regulations on the Administration of Urban and Municipal Gas", the Measures are formulated.
Article 2 Those engaged in gas business activities shall obtain a gas business license in accordance with the law and operate within the scope specified in the licensed matters.
Town gas business license application, acceptance, review and approval, document issuance and related supervision and management, etc., shall apply.
Article 3 The Ministry of Housing and Urban-Rural Development to guide the national gas business license management. Local people's governments at or above the county level, the gas management department is responsible for the administrative area of the gas business license management.
Article 4 The gas business license is issued by the gas management department of the local people's government at or above the county level, and the specific licensing department is determined in accordance with the provincial local laws and regulations, provincial people's government regulations or decisions.
The licensing department shall publicize the approval process, acceptance conditions and processing standards, public progress, and promote online business.
(F) the main person in charge of the enterprise, production safety management personnel and operation, maintenance and repair personnel by professional training and qualified by the gas management department. Professional training and assessment of specific measures to be developed separately.
The professional training and assessment of qualified personnel and the number of people, should be compatible with the scale of business operations, the minimum number of people should meet the following requirements: 1. The main person in charge. It refers to the legal representative of the enterprise and the chairman of the board of directors (executive director) and managers who are not legal representatives. All of the above personnel shall be professionally trained and qualified.
2. Production safety management personnel. Refers to the enterprise in charge of production safety, enterprise production, safety management department in charge of the enterprise production and sales branches of the person in charge and enterprise full-time safety personnel and other related management personnel. All of the above personnel should be professionally trained and qualified.
3. Operation, maintenance and repair personnel. Refers to the gas facilities and equipment responsible for the operation, maintenance and accident rescue repair operators, including but not limited to gas transmission and distribution stations, liquefied petroleum gas depot station workers, compressed natural gas station workers, liquefied natural gas storage and transportation workers, automobile refueling station operators, gas pipeline network workers, gas users repair workers, bottled gas delivery workers. The minimum number of workers shall meet the following requirements:
For piped gas operators with less than 100,000 gas users, not less than one worker for every 2,500 households; for more than 100,000 households, one worker for every additional 2,500 households;
For bottled gas operators with 1,000 or fewer gas users, not less than three workers; for more than 1,000 households and fewer than 10,000 households, one worker for every 800 households; for 1-5 million households, one worker for every additional 10,000 households; and for every additional 10,000 households, one worker for every additional 5,000 households. 10,000 households, 10 people for each additional 10,000 households; 5-100,000 households, 8 people for each additional 10,000 households; more than 100,000 households, 5 people for each additional 10,000 households;
Gas car refueling stations and other types of gas business enterprise personnel and the number of staffing as well as other operation, maintenance and emergency repair personnel, the provincial people's government, gas management department according to the specific circumstances.
(VII) other conditions prescribed by laws and regulations.
Article VI of the application for gas business license, shall submit the following application materials to the licensing department, and is responsible for its authenticity, legality and validity:
(1) gas business license application;
(2) gas gas test report; gas supply and use of gas supply contract with the gas supply enterprises;
(3) the applicant for gas facilities Completion and acceptance of the construction project, the main person in charge, safety production management personnel and operation, maintenance and emergency repair and other personnel of the professional training and assessment of qualification, the property rights or lease of fixed business premises (including office space, operation and service sites, etc.), business registration and capital structure of the enterprise's description of the situation;
(d) the requirements of Item (5) of Article 5 of the Measures for the improvement of the safety management system and sound business program materials;
(v) other materials prescribed by laws and regulations.
Article 7 The licensing department examines the applicant's application materials by means of material examination and on-site verification.
Article 8 The licensing department shall make a decision on whether to grant a license within twelve working days from the date of acceptance of the application. Twelve working days can not make a licensing decision, approved by the head of the licensing department, can be extended for ten working days, and shall inform the applicant of the reasons for the extension of time. Licensing department to make a decision to grant a permit, the applicant shall issue a "notice of granting permission", inform the applicant to obtain a gas license.
The licensing department to make a decision not to license, shall issue a "decision not to license", explaining the reasons for not licensing, and inform the applicant of the right to apply for administrative reconsideration or administrative litigation according to law.
