Regulations on Water Resources Management in Dorbod Mongolian Autonomous County of Heilongjiang Province (revised in 2006)
Article 1 In order to rationally develop, utilize and protect water resources, prevent and control water disasters, and give full play to the comprehensive benefits of water resources, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC), the Autonomous Regulations of Dorbod Mongolian Autonomous County and other relevant laws and regulations, combined with the actual situation of the Autonomous County. Article 2 These Regulations shall apply to units or individuals engaged in water activities such as water resources development, utilization, protection, management and water disaster prevention within the administrative area of Autonomous County. Article 3 The term "water resources" as mentioned in these Regulations refers to all surface water and groundwater (including mineral water and underground hot water) within the administrative area of Autonomous County. The water resources within the administrative area of the fourth Autonomous County belong to the state.

Water in ponds, reservoirs and wells of rural collective economic organizations shall be used by rural collective economic organizations.

The water in reservoirs, ponds and wells built by families, individuals and cooperatives shall be used by families, individuals and partners.

Autonomous County People's Government protects the legitimate rights and interests of units and individuals that develop and utilize water resources according to law. The water administrative department of the fifth Autonomous County People's Government shall be responsible for the unified management and supervision of water resources within their respective administrative areas.

Autonomous County People's Government shall send water resources management agencies or designated personnel to be responsible for the daily management and supervision of water resources in towns, agriculture, forestry, animal husbandry and fishery fields, railways and industrial and mining areas. Sixth Autonomous County People's government departments in accordance with the division of responsibilities, responsible for the development, utilization, conservation and protection of water resources within their respective administrative areas. Article 7 The water administrative department of an autonomous county shall, jointly with the relevant departments and the people's government of a township (town), formulate a comprehensive plan and a professional plan for the development, utilization, conservation, protection and prevention of water disasters within its administrative area according to the unified planning of river basins and regions, and report them to the people's government at the corresponding level for approval. Article 8 People's governments of autonomous counties and townships (towns) shall strengthen the management of planned water use and water conservation.

The water administrative department of the Autonomous County shall be responsible for organizing the preparation of the county's planned water use and water conservation planning, and all relevant departments shall provide assistance.

Autonomous county water supply units shall prepare water supply plans and strengthen the management of water use for users.

Autonomous county water units should do a good job in water conservation, adopt advanced technology to reduce water consumption and improve water utilization.

Autonomous County implements the system of combining total water consumption control with quota management. For units and individuals that directly take water from rivers, lakes or underground, the water resource fee will be levied at a progressive price increase for the part exceeding the quota. Ninth autonomous county water surface should be developed and utilized in various forms. Can be engaged in aquaculture, rice planting, pasture breeding, reed breeding and other production activities. You can engage in paid water supply and other business activities within the scope of water intake permit. Tenth Autonomous County People's government to adopt preferential policies to encourage and support investors inside and outside the county, inside and outside the province, at home and abroad to invest in the development and utilization of water resources in various forms according to law. Specific measures shall be formulated separately by the Autonomous County People's government. Eleventh Autonomous County to implement the water permit system.

All units and individuals who directly take water from underground, rivers and lakes must apply to the water administrative department of the Autonomous County before taking water, and after examination and approval, they can take water according to the approved use and water intake. Water intake points must be equipped with water measuring facilities in accordance with relevant regulations.

Water units and individuals shall submit water use plans to the water administrative department before taking water, and timely and accurately submit relevant statistical data. Twelfth the following small amount of water does not need to apply for water permit:

(a) drinking water for family life and autotrophic livestock and poultry;

(two) the use of small pumps to irrigate farmland along rivers and lakes;

(3) Taking water by manpower, animal power or other simple methods;

The limit of drinking a small amount of water is less than two tons per day.

The following water intake is exempt from applying for a water intake permit:

(a) agricultural drought emergency must take water;

(two) in order to prevent and eliminate the harm to public safety or public interests, it is necessary to take water. Thirteenth mining groundwater for production or business purposes, sinking and construction units shall be managed by the water administrative department of the Autonomous County.

Water units and individuals who drill wells to exploit groundwater shall apply to the water administrative department of the Autonomous County and provide relevant technical data. After investigation and demonstration, they can drill wells.

The sinking construction unit shall submit a construction application to the water administrative department and produce a qualification certificate. Only after passing the examination and issuing a construction permit can the construction be started.

After the completion of the sinking project, the construction unit shall submit a report on the completion of the project and a complete set of engineering technical data, and the water intake unit shall jointly organize the acceptance with the water administrative department. Fourteenth Autonomous County to implement the system of paid use of water resources.

Except for those that can be used free of charge according to the law, they are all paid for use. Fifteenth enterprises, institutions, organs, organizations, troops, railways, independent industrial and mining areas, agriculture, forestry, animal husbandry and fishery farms, foreign institutions and individuals directly from rivers, lakes or underground water shall pay water resources fees. Enterprises that use lakes to divert water to reduce water resources fees in autonomous counties shall be compensated. The county waterworks shall pay the water resource fee in full and on time.

Autonomous county water resources management department is responsible for the collection of water resources fees, and the collection standards and management measures for water resources fees shall be formulated separately by the Autonomous County People's Government in accordance with the relevant provisions of the state and the province.

All the water resources fees collected by Autonomous County according to law are reserved as special funds for the development, utilization, conservation, protection and management of water resources in Autonomous County.
