(3) Terrestrial wild animals and other terrestrial wild animals with important ecological, scientific and social values announced by the wildlife protection department of the State Council, including artificially propagated and artificially raised terrestrial wild animals;
(four) other wild animals prohibited by laws and regulations and the relevant provisions of the state and province. Article 5 The species listed in the Catalogue of Artificial Breeding of Aquatic Wild Animals under Special State Protection shall be managed in accordance with the Decision of NPC Standing Committee on the Total Prohibition of Illegal Wildlife Trading, so as to put an end to the bad habit of eating wild animals and effectively protect people's lives, health and safety.
Aquatic wild animals other than aquatic wild animals under special state protection, aquatic animals listed in the list of aquatic economic animal and plant resources under special state protection, and new aquatic products announced by the Ministry of Agriculture and Rural Affairs shall be governed by the Fisheries Law of People's Republic of China (PRC) and the Fisheries Regulations of Jiangxi Province; The aquatic wild animals listed in the List of Provincial Key Protected Aquatic Wild Animals in Jiangxi Province shall be subject to the Measures for the Implementation of the People's Republic of China (PRC) Wildlife Protection Law in Jiangxi Province.
Animals listed in the catalogue of livestock and poultry genetic resources formulated and published by the animal husbandry and veterinary administrative department of the State Council shall be quarantined according to the provisions of the Animal Husbandry Law of People's Republic of China (PRC) and other relevant laws and regulations. Article 6 No unit or individual may produce, market or use foods made by wild animals, or make advertisements, signboards or recipes with the names, nicknames and patterns of wild animals that are forbidden to eat, so as to attract or induce customers to eat them. Article 7 Where it is necessary to make non-edible use of wild animals due to special circumstances such as scientific research, medical treatment, exhibition, tourism, species protection, provenance breeding and cultural relics protection, strict examination and approval and quarantine shall be conducted according to law. Article 8 It is forbidden to hunt, trade or transport terrestrial wild animals that naturally grow in the wild environment for the purpose of eating.
Anyone who hunts, trades, transports, uses, carries or delivers wild animals shall hold corresponding hunting license, hunting and catching license, special signs, artificial breeding license, approval documents or copies of import and export certificates and other legal source certificates and quarantine certificates in accordance with the law for inspection. Article 9 It is forbidden for online trading platforms, commodity trading markets, restaurants and other trading and consumption places, as well as operators such as transportation, warehousing and express delivery to provide trading or consumption services for illegally eating wild animals and hunting tools prohibited from being used. Article 10 People's governments at or above the county level shall strengthen their leadership over the work of prohibiting illegal trading and consumption of wild animals, and organize, coordinate and urge relevant departments to perform their duties of supervision and management according to law.
The relevant departments of the people's governments at or above the county level, such as wildlife protection, market supervision and management, public security, etc., shall be responsible for the supervision and management of prohibiting illegal trading and consumption of wild animals in accordance with the division of responsibilities.
Township (town) people's governments and sub-district offices shall do a good job in prohibiting illegal trading and eating wild animals. Eleventh after the implementation of these measures, the competent department of wildlife protection of the provincial people's government shall organize the relevant departments to change, cancel or withdraw the license prohibiting the artificial feeding or operation and utilization of edible wild animals within the specified time. To change according to law, we should improve the relevant examination and approval system and strengthen the examination and approval management according to law. Twelfth people's governments at or above the county level and relevant departments shall guide and help farmers affected by the implementation of these measures to adjust and change their production and business activities, and give support in employment training, social security, financing and taxation according to the actual situation. Article 13 People's governments at all levels, people's organizations, social organizations, schools, news media and other social departments should actively carry out publicity, education and guidance on laws and regulations on ecological environmental protection, public health and safety, prohibition of eating wild animals and related knowledge. Members of the whole society should consciously enhance their awareness of ecological protection and public health and safety, and develop a scientific, healthy and civilized lifestyle. Fourteenth people's governments at all levels, the competent department of wildlife protection and the relevant departments of market supervision and management, public security, Internet information, transportation, customs, postal management and so on. We should improve the law enforcement management system, clarify the subject of law enforcement responsibility, implement the law enforcement management responsibility, strengthen coordination, strengthen supervision and inspection and accountability, and strictly investigate and deal with violations of relevant laws and regulations and these measures; The illegal business premises and illegal operators shall be sealed up, closed or banned according to law.
