Regulations of Changzhi Municipality on the Administration of Rural Self-built Houses
Article 1 In order to strengthen and standardize the management of self-built houses in rural areas, improve the construction quality of self-built houses in rural areas, ensure the safety of self-built houses in rural areas, guide villagers to make intensive and economical use of land resources, improve villagers' living environment and conditions, and promote the construction of beautiful countryside, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 Within the administrative area of this Municipality, these Regulations shall apply to the management activities related to the construction, renovation, expansion and renovation of low-rise residential buildings by rural villagers on the homestead outside the urban development boundary.

Where laws and regulations provide otherwise for the management of rural self-built houses, such provisions shall prevail. Article 3 Self-built houses in rural areas shall meet the needs of villagers' modern life, respect local history and culture, regional characteristics and rural features, adhere to the combination of management according to law and villagers' autonomy, and adhere to the principles of planning first, ecological protection, adapting measures to local conditions, economy and intensive, one household, one house, safety and application. Article 4 The examination and approval of rural homestead and self-built house planning shall conform to the village planning. If the village planning is not prepared, it shall conform to the township (town) land and space planning. Self-built houses in rural areas located in nature reserves, scenic spots, cultural relics protection units, historical and cultural towns and villages, ethnic minority villages and traditional villages shall also conform to relevant special plans. Fifth new rural self-built houses should give priority to the use of the original homestead and village homestead. If it is really necessary to occupy agricultural land, the examination and approval procedures for the conversion of agricultural land shall be handled according to law. Shall not occupy permanent basic farmland. Article 6 The natural resources department of the county (district) people's government shall, according to the demand for new construction land for farmers' self-built houses provided by the agricultural and rural departments, make overall arrangements for the planned indicators of new construction land to ensure villagers' self-built construction land. Article 7 Villagers' homesteads shall be calculated by households, and each household can only own one homestead. The newly applied homestead area is no more than 200 square meters per household. Eighth city and county (District) people's government departments of agriculture, rural areas and natural resources to guide and supervise the management of rural homestead approval. The township (town) people's government is responsible for the daily work of the examination and approval management of homestead.

County (District) people's government shall, in accordance with relevant laws and regulations, formulate detailed rules for the implementation of the examination and approval management of rural residential land suitable for local conditions. Ninth rural self-built houses should avoid geological disasters, flood-prone areas, underground mined-out areas, earthquake fault zones and other dangerous areas. If it is really necessary to build houses in the above areas, it shall conform to the village planning and be implemented in accordance with the disaster prevention and mitigation measures formulated in the planning. If the village planning is not prepared, it shall be implemented as required after comprehensive evaluation in the village. Tenth strictly control the slope cutting to build houses. If it is really necessary to cut the slope due to difficulties in land use, it shall, under the guidance of the township (town) people's government and other relevant departments, do a good job in slope protection in accordance with relevant technical specifications to ensure the safety of self-built houses. Eleventh rural self-built houses should be based on households, and apply for rural housing planning permits according to law.

The application for examination and approval of rural self-built houses and homesteads shall conform to the provisions for examination and approval of rural homesteads formulated by the state and the province. Twelfth villagers who have no homestead apply for construction planning permission and homestead, and the township (town) people's government shall merge the approval letter of rural homestead with the rural construction planning permit according to law and issue it at the same time. Thirteenth county (District) people's government shall, in accordance with the relevant laws and regulations, formulate the location, area, number of floors and height of rural self-built houses and the detailed rules for the implementation of planning approval management. Article 14 The people's government of a township (town) shall establish an open system for the examination and approval of rural self-built housing planning, and actively disclose village planning or township (town) land and space planning, application conditions, examination and approval procedures, examination and approval results, commitments and complaint reporting methods in places such as government information disclosure platforms and public columns. Fifteenth rural self-built housing construction activities should implement the relevant standards, norms and operating procedures of housing construction to ensure the quality and safety of the project. Sixteenth county (District) people's government departments in charge of housing and urban and rural construction shall give guidance to rural self-built housing construction activities.

Township (town) people's government planning and construction office is responsible for the management of rural self-built housing construction activities, do a good job in construction registration and completion data filing, supervise and manage the construction process, and provide technical services. Seventeenth city and county (District) people's government housing and urban and rural construction departments should adjust measures to local conditions, the preparation of rural self-built low-rise residential design general atlas, free for building people to choose.

County (District) people's government housing and urban and rural construction, market supervision departments shall formulate a model text of rural self-built housing construction contract. Eighteenth housing is the main body of rural self-built housing construction activities, and bears the main responsibility for housing construction and use. The owner of the building shall choose the design drawings, the constructor and the supervisor that meet the requirements, and consciously accept the supervision and management of the township (town) people's government and the villagers' committee. Nineteenth units that meet one of the following conditions can undertake the design, construction and supervision projects of self-built low-rise residential buildings in rural areas within the administrative area of this Municipality:

(a) qualified architectural design, construction and supervision units;

(2) Rural housing construction professional cooperatives, rural housing construction companies, rural housing construction supervision companies and construction labor service companies established according to law.

Individuals who meet one of the following conditions can undertake the design and supervision projects of self-built low-rise residential buildings in rural areas:

(a) technical personnel with industry qualifications in the field of housing and urban and rural construction or intermediate or above titles in construction engineering;

(two) trained and qualified rural construction craftsmen.
