Any organization or individual has the right to report or accuse violations of this law to relevant departments and organs. The competent department of wildlife protection and other relevant departments and organs shall promptly handle reports or complaints according to law.
Article 341 of the Criminal Law of People's Republic of China (PRC) illegally hunts and kills rare and endangered wild animals under special state protection, or illegally buys, transports or sells rare and endangered wild animals under special state protection and their products, and shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention and shall also be fined; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years and shall also be fined; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than 10 years and shall also be fined or confiscated.
Whoever, in violation of hunting laws and regulations, hunts in a no-hunting area or during a no-hunting period or uses prohibited tools and methods to destroy wildlife resources, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or a fine.
Article 21 of the Wildlife Protection Law of People's Republic of China (PRC) prohibits hunting and killing of wildlife under special state protection.
Because of scientific research, population control, epidemic monitoring or other special circumstances, it is necessary to hunt wild animals under national first-class protection, and it shall apply to the competent department of wildlife protection in the State Council for a special hunting and catching license; Anyone who needs to hunt wild animals under second-class state protection shall apply to the wildlife protection department of the people's government of a province, autonomous region or municipality directly under the Central Government for a special hunting and catching license.
