1. Whether the receipt is valid depends on the following details:
(1) If the receipt is signed or sealed, the signature is valid;
(2) If the receipt is required to be stamped, but it is not stamped, and the unit does not recognize it, the effect is to be determined.
Under normal circumstances, the receipt without official seal is of little effect, because the receipt without official seal is not recognized in law, so the receipt must be stamped with official seal or the signature of the party concerned.
2. Legal basis: Article 502 of the Civil Code of People's Republic of China (PRC).
A legally established contract shall come into force upon its establishment, except as otherwise provided by law or agreed by the parties.
In accordance with the provisions of laws and administrative regulations, if the contract should go through the approval procedures, such provisions shall prevail. If the failure to go through the formalities such as approval affects the effectiveness of the contract, it will not affect the performance of the obligation clauses such as approval and the effectiveness of relevant clauses in the contract. If the party that should go through the formalities for approval fails to perform its obligations, the other party may require it to bear the responsibility for violating its obligations.
The modification, assignment and dissolution of a contract shall be subject to the provisions of laws and administrative regulations, and the provisions of the preceding paragraph shall apply and shall be subject to approval.
Second, can the receipt be used as an iou?
Receipts cannot be used as IOUs. If the receipt only proves that the capital relationship between the two parties has been transferred, it is only a handover relationship, and it cannot prove that one party lends money to the other. It is legally impossible to determine whether the transferred property is a loan relationship. It is better to have an IOU, which means that an IOU has indeed been generated, but the IOU cannot prove that it is a loan relationship.
