The crime of sabotaging production and operation refers to the act of destroying machinery and equipment, hurting farm animals or sabotaging production and operation in other ways for revenge or other personal purposes. Production and operation activities refer to the production and operation activities of the whole society, including state-owned, collective and individual production and operation activities. The subject of this crime is the general subject, that is, any natural person who has reached the age of 16 and has criminal responsibility can constitute the subject of this crime. Subjectively, this crime is intentional, and negligence does not constitute this crime. When the actor carries out the act of destroying production and operation, he has the purpose of venting his personal anger and retaliating against others, and actively pursues this result.
According to the relevant laws and regulations of our country, anyone who destroys machinery and equipment, mutilates farm animals or destroys production and operation in other ways due to anger and revenge or other personal purposes, who is suspected of one of the following circumstances, shall file a case for prosecution:
1, causing losses of public and private property of more than 5,000 yuan;
2, the destruction of production and operation for more than three times;
3. Assembling three or more people to openly sabotage production and operation.

Article 34
For anger, revenge or other personal purposes, anyone who destroys machinery and equipment, mutilates livestock or sabotages production and operation by other means is suspected of one of the following circumstances, and shall file a case for prosecution:
(1) Causing losses of more than 5,000 yuan to public or private property;
(two) the destruction of production and operation for more than three times;
(3) Assembling three or more people to openly disrupt production and operation;
(four) other circumstances that should be investigated for criminal responsibility for disrupting production and operation.
