The competent customs shall be responsible for the supervision and administration of the inspection and quarantine of vegetables supplied to Hong Kong and Macao within its jurisdiction. Article 4 The Customs shall record the vegetable planting bases for Hong Kong and Macao (hereinafter referred to as planting bases) and the vegetable production and processing enterprises for Hong Kong and Macao (hereinafter referred to as production and processing enterprises). Planting bases and production and processing enterprises shall file with the customs. Fifth planting bases, production and processing enterprises or farmers' specialized cooperative economic organizations shall be responsible for the quality and safety of vegetables supplied to Hong Kong and Macao. Planting bases and production and processing enterprises shall engage in planting, production and processing activities in accordance with China laws, regulations, rules and food safety standards, establish and improve the quality and safety control system and quality traceability system in the whole process from planting, processing to exit, and ensure that vegetables supplied to Hong Kong and Macao meet the relevant inspection and quarantine requirements of Hong Kong or Macao Special Administrative Regions. If there are no relevant inspection and quarantine requirements in Hong Kong and Macao Special Administrative Regions, they shall meet the relevant inspection and quarantine requirements in the Mainland. Article 6 The Customs shall supervise the cultivation, production and processing of vegetables for Hong Kong and Macao, and conduct random inspection of vegetables for Hong Kong and Macao. Article 7 The Customs shall establish a risk early warning and rapid response system for vegetables supplied to Hong Kong and Macao. Chapter II Filing and Management of Planting Bases Article 8 The competent customs shall carry out filing management of planting bases. Except for small varieties of vegetables as otherwise stipulated by the General Administration of Customs, vegetables not in the filing base shall not be used as raw materials for processing vegetables for Hong Kong and Macao. Ninth planting bases, production and processing enterprises or farmers' professional cooperative economic organizations (hereinafter referred to as the main body of planting bases for the record) shall apply to the customs where the planting bases are located for the record.
Planting bases subject to regional management can be recommended by relevant departments of the local government to the customs for the record. Article 10 A planting base applying for filing shall meet the following conditions:
(1) Having legal land use documents;
(2) The land is fixed and contiguous, surrounded by natural or artificial isolation belts (nets), which meet the land area requirements determined by the local customs according to the actual situation;
(three) the soil and irrigation water meet the requirements of the relevant national standards, and there are no pollution sources around that affect the quality and safety of vegetables;
(4) There is a special department or person in charge of the management of agricultural inputs such as pesticides, and there is a storage place for agricultural inputs managed by a special person; There are special pesticide spraying tools and other agricultural instruments;
(5) Having a sound quality and safety management system, including the organization, the management system for the use of agricultural inputs and the monitoring system for toxic and harmful substances;
(six) full-time or part-time management personnel with basic knowledge of plant protection;
(seven) have the ability to detect pesticide residues. Eleventh planting base filing subject shall submit a written application to the customs where the base is located, and submit the following materials:
(1) An application form for filing vegetable planting bases in Hong Kong and Macao;
(2) Schematic diagram and plan of planting base;
(three) a copy of the identity card of the person in charge or operator of the planting base. Article 12 If the filing subject of planting base submits complete materials, the customs shall accept the filing application.
If the materials submitted by the filing subject of the planting base are incomplete, the customs shall inform the filing subject of the planting base to make corrections in writing on the spot or within five working days after receiving the application, and the date of acceptance shall be the applicant's date of correction.
After accepting the application, the customs shall examine it in accordance with the provisions of Articles 10 and 11 of these Measures. The audit shall be completed within 10 working days from the date of acceptance. Those that meet the requirements shall be put on record, numbered according to the rule of "administrative division code of provinces (autonomous regions and municipalities directly under the Central Government) ++ SC ++ five digits", and a record certificate shall be issued. If it does not meet the requirements, it will not be filed, and the customs will notify the filing subject of the planting base in writing. Article 13 If the person in charge of the planting base changes, it shall apply to the customs where the planting base is located for filing and changing the planting base within 30 days from the date of change. Fourteenth planting bases for the record shall establish a record system for vegetable production in Hong Kong and Macao, and truthfully record the following items:
(a) the name, source, usage, dosage, date of use and pesticide safety interval of agricultural inputs;
(2) Occurrence and control of pests and diseases;
(3) the date and quantity of harvest;
(4) product sales and flow direction.
Production records shall be kept for 2 years. It is forbidden to forge production records. Article 15 The person in charge of the planting base shall use agricultural inputs such as pesticides, fertilizers and growth regulators in accordance with the food safety standards and relevant regulations of Hong Kong, Macao Special Administrative Region or the Mainland, and it is forbidden to purchase or use agricultural inputs that do not meet the food safety standards of Hong Kong, Macao Special Administrative Region or the Mainland.
