Measures for the Administration of Quarantine of Imported Fruits Chapter I General Provisions
Article 1 These Measures are formulated in accordance with the relevant provisions of the Entry-Exit Animal and Plant Quarantine Law of People's Republic of China (PRC) and its implementing regulations in order to prevent the introduction of plant dangerous pests into China and protect the safety of fruit production and human health in China.
Article 2 These Measures shall apply to the quarantine of tomatoes, eggplants and peppers in fresh fruits and solanaceae vegetables imported from abroad.
Article 3 The State Administration of Entry-Exit Inspection and Quarantine (hereinafter referred to as the State Administration of Inspection and Quarantine) shall uniformly administer the quarantine examination and approval of imported fruits throughout the country. The entry-exit inspection and quarantine institution established by the State Administration of Inspection and Quarantine (hereinafter referred to as the inspection and quarantine institution) is responsible for the quarantine and supervision of imported fruits in this region.
Article 4 It is forbidden to import fruits produced in countries or regions where Bactrocera mediterranean occurs. Fruit varieties exported to China for the first time from outside the epidemic area must undergo pest risk assessment and sign a quarantine protocol with the exporting country before they can be imported.
Article 5 It is forbidden to bring or mail fruits into the country, unless otherwise stipulated by laws and regulations.
Chapter II Quarantine Examination and Approval
Article 6 Before fruits are imported, the consignor, the consignor or his agent must file an application in advance and go through the quarantine examination and approval procedures before signing a trade contract or agreement.

Article 8 The quarantine examination and approval procedures for imported fruits are as follows:

Article 9 The owner, the owner or his agent shall go through the formalities for examination and approval of entry quarantine again under any of the following circumstances:
(1) Changing the varieties of imported fruits or increasing the quantity of imported fruits;

(3) Changing the port of entry;

Chapter III Entry Quarantine
Article 10 The consignor, the consignor's agent shall apply to the entry inspection and quarantine organ for inspection before or when the fruit enters the country, and submit the Import Animal and Plant Quarantine Permit of People's Republic of China (PRC) and the State Entry-Exit Inspection and Quarantine Bureau, the plant quarantine certificate, certificate of origin, trade contract, invoice and other documents issued by the animal and plant quarantine organ of the exporting country or region.
Article 11 If the imported fruits do not have the plant quarantine certificate issued by the animal and plant quarantine organ of the exporting country or region, or fail to go through the quarantine examination and approval procedures according to law, the inspection and quarantine organ at the place where the port of entry is located may return them or destroy them according to the specific circumstances.
If the fruits purchased in Hong Kong and Macao really cannot provide the official plant quarantine certificate of the exporting country or region, they shall be inspected by the certification documents issued by the relevant agricultural product inspection institutions in Hong Kong and Macao confirmed by the State Administration of Inspection and Quarantine and the above-mentioned relevant documents. If the small-scale border trade of imported fruits cannot provide the phytosanitary certificate due to the restriction of trade conditions, it shall obtain the consent of the entry-exit inspection and quarantine institution directly under it in advance.
Article 12 The quarantine basis for imported fruits includes:
(a) China plant quarantine laws and regulations;
(2) Bilateral agreements signed between the government of China and the governments of exporting countries or regions;
(three) the agreement signed by the State Inspection and Quarantine Bureau and the plant quarantine department of the exporting country or region (including protocols and memorandums, etc.). );
(4) Quarantine requirements for the quarantine license;
(5) Quarantine requirements stipulated in the trade contract.
Article 13 Imported fruits must meet the following quarantine conditions:
(1) Conforming to the relevant bilateral quarantine agreements signed between China and exporting countries or regions;
(2) It does not contain plant dangerous pests prohibited from entering China, and does not contain branches and leaves and soil;
(three) the original packaging imported, with obvious marks of origin;
(4) Meeting other requirements of bilateral agreements.
Article 14 When carrying out on-site quarantine, the inspection and quarantine institution shall check the conformity of the goods certificate, conduct inspection according to the condition of the goods, conduct spot checks and sampling according to relevant procedures and standards, and write off the goods according to the varieties and quantity (weight) actually inspected.

Article 15 After quarantine, imported fruits shall be treated as follows:
(1) Those who pass the quarantine inspection shall be issued with the Entry-Exit Inspection and Quarantine Clearance Form and allowed to enter the country.
(2) If plants are found to be dangerous, harmful organisms or general pests and diseases that exceed the prescribed standards after quarantine inspection, they must be disinfected, and those that pass the treatment shall be allowed to enter the country; If the quarantine is unqualified and there is no effective method for disinfection, it will be returned or destroyed.

Chapter IV Quarantine Supervision
Article 16 The State Administration of Inspection and Quarantine shall implement a registration system for foreign orchards, processing and storage units that export fruits to China.
The State Administration of Inspection and Quarantine may, according to quarantine needs and with the consent of the relevant authorities of the exporting country or region, send personnel to the place of origin for pre-inspection, loading supervision or epidemic investigation.
Seventeenth fruits from epidemic areas must go through special quarantine examination and approval procedures with the State Inspection and Quarantine Bureau in advance. During the exhibition, they must accept the supervision and management of the inspection and quarantine institutions, and may not use, give away, sell or transfer them without the permission of the inspection and quarantine institutions. Waste fruits should be disposed of under the supervision of inspection and quarantine institutions.
Article 18 Imported fruits for sale by Hong Kong and Macao through trains and ships shall be sealed and packaged under the supervision of inspection and quarantine institutions, and passed the quarantine inspection. When passengers are brought into the country, the quarantine officers can conduct spot checks according to the actual situation on the basis of the above-mentioned packaging inspection and release.
Article 19 Imported fruits sold in duty-free shops before customs clearance can only be sold in sealed bags under the supervision of inspection and quarantine institutions after passing the quarantine inspection, and are subject to the supervision and management of inspection and quarantine institutions.
Twentieth international ships, trains and planes stay in China, transportation practitioners and other personnel shall not take the fruit for catering away from the means of transportation; Wastes such as peels and stones used in catering should be treated harmlessly under the supervision of inspection and quarantine institutions.
Ships, planes and trains from animal and plant epidemic areas must seal up or destroy fruits that are prohibited from entering the country; Those sealed shall not be unsealed and used without the permission of the inspection and quarantine organ during their stay or operation in China.
Article 21 The State Administration of Inspection and Quarantine may, according to the actual situation, designate relevant inspection and quarantine institutions to carry out quarantine supervision on fruits that are allowed to be re-exported or re-exported.
Twenty-second inspection and quarantine institutions may, according to the needs, carry out epidemic monitoring in airports, ports, stations, warehouses, processing plants and other places, and the relevant units shall cooperate.

Chapter V Supplementary Provisions
Twenty-third parties who violate these measures shall be punished in accordance with the Law of People's Republic of China (PRC) on Entry-Exit Animal and Plant Quarantine and its implementing regulations.
Article 24 The State Administration of Inspection and Quarantine shall be responsible for the interpretation of these Measures.
