Hefei Publications Market Management Measures (Revised in 2018)

Article 1 In order to strengthen the management of this city's publication market and standardize business activities, these measures are formulated in accordance with the State Council's "Publication Management Regulations", "Measures for Investigation and Punishment of Unlicensed Business Operations" and other administrative regulations, and in light of the actual situation of this city.

Article 2 All units and individuals engaged in publication distribution activities within the administrative area of ??this city shall abide by these Measures.

The term "publications" as mentioned in these Measures refers to books, newspapers, periodicals, audio-visual products, and electronic publications; the term "distribution" refers to activities such as wholesale, retail, rental, and exhibition sales.

Article 3 The municipal press and publication administrative department is responsible for the supervision and management of the municipality’s publications market.

The press and publication administrative departments of each county (city) and district or the relevant administrative departments that perform press and publication administrative functions (hereinafter collectively referred to as the press and publication administrative departments) are responsible for the supervision and management of the publications market within their respective jurisdictions.

The municipal press and publication administrative department may entrust the management agencies of Hefei High-tech Industrial Development Zone, Hefei Economic and Technological Development Zone, and Hefei Xinzhan High-tech Industrial Development Zone in accordance with the law to be responsible for the supervision and management of the publication market in their respective regions.

Industry and commerce, public security, urban management and other departments shall be responsible for relevant publications market supervision and management in accordance with their respective responsibilities.

Postal, customs, railway, civil aviation, highway, water transport and other units shall assist the press and publication administrative department in the supervision and management of the publication market.

Article 4 Units and individuals engaged in the wholesale and retail business of publications must obtain a business license from the industrial and commercial department in accordance with the law, and obtain approval from the press and publication administrative department. Only after obtaining relevant licenses can they engage in the wholesale and retail business of publications.

Units and individuals that engage in the wholesale and retail business of publications through the Internet and other information networks must go through relevant licensing procedures in accordance with the provisions of the preceding paragraph.

Units and individuals that have obtained a publication business license and engage in publication wholesale and retail business through the Internet and other information networks within the approved business scope shall go to the original approving press and publication administrative department within 15 days of starting online wholesale or retail business.

Filing.

No unit or individual may entrust non-publication wholesale or retail units or individuals to sell publications or act as agents for the sale of publications.

Article 5 Wholesale, retail, and rental publications must be operated in a fixed place with a license (license), and are not allowed to move around or set up stalls at will, and are not allowed to obstruct traffic or affect the city appearance.

Those who use the Internet and other information networks to engage in wholesale and retail business shall publish the relevant information or link logos of their business licenses and business licenses in a conspicuous position on the main page of their website or the webpage where they engage in business activities.

Article 6 Units and individuals engaged in the wholesale and retail business of publications shall engage in business operations in accordance with the business scope and business address stipulated in the publication business license. If the name, business scope, business address, legal representative and other registration matters are changed, they shall

Report to the original approving press and publication administrative department to go through the change procedures; if business activities are terminated, a record should be filed with the original approving press and publication administrative department within 15 days, and the original approving press and publication administrative department will cancel the publication business license.

Article 7 No unit or individual may issue the following publications: (1) Prohibited publications containing content prohibited by the "Publication Administration Regulations"; (2) Various illegal publications, including: unauthorized publication, printing or reproduction

Publications, publications that forge or counterfeit the names of publishing units or newspapers and periodicals, illegally imported publications, publications that buy and sell book numbers, issue numbers, edition numbers, etc.; (3) Publications that infringe the copyright or exclusive publishing rights of others

; (4) Publications that are expressly prohibited from being published, printed or reproduced or distributed by the administrative department of press and publication.

(5) Publications with content prohibited by other laws, regulations and national regulations.

Article 8 Units and individuals engaged in the distribution of publications shall keep the purchase and sale list of publications and other relevant non-financial notes for at least 2 years for inspection.

Article 9 Internal information publications are distributed free of charge by the compilation and printing units, and are not allowed to be distributed by any unit or individual.

Article 10 Those engaged in storage, transportation, delivery and other activities of publications shall be subject to supervision and inspection by the press and publication administrative department.

Article 11: No unit or individual may provide business premises or conditions for warehousing, transportation, storage, attachment, mailing, etc. to those who operate publications without a license or operators of illegal publications.

Market operators shall check the business licenses of publication operators, shall not accept unlicensed publication operators, and shall assist the press and publication administrative department in investigating and handling activities that operate publications without a license.

Article 12 Anyone who engages in the wholesale or retail business of publications without obtaining a publication business license shall be banned by the press and publication administrative department in accordance with the law, and the publications, illegal gains, and special tools and equipment used for illegal activities shall be confiscated; the illegal business amount shall be 10,000 yuan

If the illegal business amount exceeds RMB 10,000, a fine of not less than five times but not more than ten times the illegal business amount shall be imposed. If the illegal business amount is less than RMB 10,000, a fine of not more than RMB 50,000 may be imposed. Those who infringe upon the legitimate rights and interests of others shall bear civil liability in accordance with the law; suspected of committing a crime.
