Legal Basis: The Law of the People's Republic of China on the Protection of Wild Animals
Article 25 The State shall support the relevant scientific research institutions to artificially breed wild animals under the State's key protection for the purpose of species protection. A licensing system shall be implemented for the artificial breeding of wild animals under State Key Protection other than that provided for in the preceding paragraph. Artificial breeding of wild animals under national key protection shall be approved by the wildlife protection department of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, to obtain a breeding license, but the State Council on the approval of the authorities, except as otherwise provided. Artificial breeding of wild animals under national key protection shall use the seed source of artificial breeding offspring, and establish the genealogy of the species, breeding files and individual data. Where it is necessary to use wild seed sources for the purpose of species protection, the provisions of Articles 21 and 23 of this Law shall apply. Artificial breeding offspring referred to in this Law, refers to the offspring of individuals born under artificially controlled breeding conditions and their parents were also born under artificially controlled conditions.
Article 47 Violation of the provisions of the second paragraph of Article 25 of this Law, without obtaining an artificial breeding license to breed wild animals under State Key Protection or the wild animals stipulated in the second paragraph of Article 28 of this Law, the competent department for the protection of wild animals of the people's governments at or above the county level shall confiscate the wild animals and their products, and impose a fine of not less than one but not more than five times the value of the wild animals and their products.
