Thirty-first illegal killing of wildlife under special state protection shall be carried out in accordance with the provisions of Article 33 of the Regulations for the Implementation of Terrestrial Wildlife Protection in People's Republic of China (PRC) and Article 26 of the Regulations for the Implementation of Aquatic Wildlife Protection in People's Republic of China (PRC).

Article 32 Anyone who, in violation of the provisions of these Regulations, hunts and hunts wild animals under provincial and local key and general protection in game reserves, hunting seasons and fishing seasons shall be confiscated by the department of wildlife administration and fined not more than 8 times the value of the hunted animals; If there is no catch, a fine of less than 2000 yuan shall be imposed.

Article 33 Anyone who, in violation of the provisions of these Regulations, fails to hunt wild animals in accordance with the provisions of hunting license or hunting license, shall be confiscated by the wildlife administrative department, and shall be fined less than five times the value of the hunted animals, and hunting tools may be confiscated and hunting license revoked; If they are not caught, they shall be fined 1 1,000 yuan, and the hunting tools may be confiscated and hunting license revoked.

Article 34 Whoever, in violation of the provisions of this Ordinance, destroys the main habitats and breeding places of wildlife under special state or provincial protection in nature reserves and game reserves shall be ordered by the wildlife administrative department to stop the destruction, restore to the original state within a time limit and be fined less than three times the cost of restoring to the original state; Those who destroy the main living and breeding places of key protected wild animals shall be ordered by the wildlife administrative department to stop the destruction, make restitution within a time limit, and be fined 2 times the cost of restitution.

Units and individuals ordered to make restitution within a time limit may pay the fees required for restitution to the wildlife administrative department, which will make restitution on their behalf.

In violation of the provisions of this Ordinance, the destruction of wild animal nests and caves, depending on the seriousness of the case, impose a fine of more than 50 yuan 1000 yuan.

Thirty-fifth in violation of the provisions of this Ordinance, without obtaining the domestication and breeding license or beyond the scope of domestication and breeding license provisions of the provincial and local key and general protection of wild animals, shall be ordered to make corrections within a time limit. If no correction is made within the time limit, the illegal income shall be confiscated by the wildlife administrative department, and a fine of less than 2,000 yuan may be imposed, and wild animals may be confiscated.

Article 36 Anyone who, in violation of the provisions of these Regulations, sells or purchases wild animals and their products shall be confiscated by the wildlife administrative department or the administrative department for industry and commerce according to the prescribed authority, and may also be fined less than 10 times the value of the goods, and his business license shall be revoked.

Article 37 Whoever, in violation of the provisions of this Ordinance, illegally uses wildlife and its products under special state and provincial protection as dishes shall be confiscated by the wildlife administrative department, and shall be fined between 2,000 yuan and 50,000 yuan according to the types and quantity of wildlife and its products; With the names or other names of national and provincial key protected wild animals and their products as recipes, the administrative department of wildlife shall impose a fine of 200 yuan to 2000 yuan.

Those who print, broadcast, produce, manage and use advertisements of wild animals and their products without the examination and approval of the administrative department of wild animals shall be punished in accordance with the relevant provisions of the Advertising Law of People's Republic of China (PRC).

Article 38 Anyone who, in violation of the provisions of these Regulations, transports, carries or mails wild animals and their products without a transport license shall be confiscated by the wildlife administrative department, and those belonging to the national, provincial and local key protected wild animals and their products may be fined 10 times the physical value; Belonging to the general protection of wild animals and their products, a fine equivalent to less than 3 times the physical value may be imposed; If the wild animals and their products transported, carried or mailed are inconsistent with the transport certificate, the excess part shall be confiscated and a fine of less than 2 times the physical value of the excess part may be imposed.

Article 39 Whoever, in violation of the provisions of these Regulations, provides storage and trading tools and places for illegal hunting, trading, transportation, carrying, mailing and smuggling of wild animals and their products shall be confiscated by the wildlife administrative department and fined between 654.38 million yuan and 654.38 million yuan.

Article 40 Whoever, in violation of the provisions of these Regulations, forges, resells, transfers or alters hunting license, domestication and breeding license, business license and transportation license shall be fined not more than 5,000 yuan by the wildlife administrative department; Whoever forges, resells, transfers or alters a special hunting and catching license, a special fishing license or an import and export permit certificate shall be fined between 5,000 yuan and 50,000 yuan.

Forty-first wildlife administrative departments may detain and seal up wildlife and its products when investigating and dealing with violations of wildlife protection laws and regulations according to law.

Wild animals and their products confiscated and detained by the relevant departments according to law must be handed over to the local wildlife administrative department for handling in accordance with relevant state regulations.

Illegal operation and utilization of wild animals and their products, in addition to punishment according to law, by the administrative department of wildlife according to the national and provincial standards of 2 to 5 times the collection of wild animal resources protection and management fees.

Forty-second wildlife administrative departments shall implement administrative punishment in accordance with the procedures stipulated in the Administrative Punishment Law of the People's Republic of China.

Forty-third violations of wildlife protection laws and regulations constitute a crime, criminal responsibility shall be investigated according to law.

Article 44 If a party refuses to accept the administrative punishment, he may apply for reconsideration or bring a lawsuit to the people's court in accordance with the Regulations on Administrative Reconsideration and the Administrative Procedure Law of the People's Republic of China.

Article 45 Any staff member of the wildlife administrative department who neglects his duty, abuses his power or engages in malpractices for selfish ends shall be given administrative sanctions by his unit or the competent authority at a higher level; If a crime is constituted, criminal responsibility shall be investigated according to law.
